RESOLUTION NO. 29 <br />SERIES 1999 <br /> <br />A RESOLUTION APPROVING A CONTRACT BETWEEN THE CITY AND THE <br />COLORADO DEPARTMENT OF TRANSPORTATION; AUTHORIZING THE MAYOR <br />TO EXECUTE THE CONTRACT ON BEHALF OF THE CITY; AND AUTHORIZING <br />THE MAYOR AND CITY STAFF TO DO ALL THINGS NECESSARY IN <br />FURTHERANCE OF THE CONTRACT. <br /> <br /> WHEREAS, the Colorado Department of Transportation (CDOT) is currently involved in a <br />bridge replacement project on 88th Street over U.S. Highway 36; and <br /> <br /> WHEREAS, the City has requested that CDOT extend the project northerly to the <br />intersection of 88th Street and Health Park Drive, which additional work would be completed in <br />conjunction with CDOT's project and paid for by the City; and <br /> <br /> WHEREAS, the City has previously committed City funds to pay the estimated cost of <br />$156,000 for the additional work; and <br /> <br /> WHEREAS, the City must execute a contract with CDOT to define the respective <br />responsibilities of each party with regard to completion of the additional work; and <br /> <br /> WHEREAS, the City is authorized to contract with CDOT under the authority of sections <br />29-1-203, 31-15-101 and 43-2-144, C.R.S., as amended; and <br /> <br /> WHEREAS, the City Council has reviewed the proposed contract with CDOT, a copy of <br />which is attached hereto, and finds and determines that execution of such contract is in the best <br />interest of the public health, safety and welfare. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The City Council hereby approves that certain Contract by and between the City and <br />the Colorado Department of Transportation (CDOT) for funding of certain improvements on 88th <br />Street (Project Number 11870 pE and 12359 CONST.), in essentially the same form as the copy of <br />such Contract accompanying this Resolution (the "Contract"). <br /> <br /> 2. The Mayor is authorized to execute the Contract, except that the Mayor is hereby <br />granted the authority to negotiate and approve such revisions to the Contract as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions o/f the Contract are not altered. <br /> <br />3. The Mayor, City Administrator and City Staff are further authorized to do all things <br /> <br /> <br />
