station 9+72 (the intersection of 88th Street and Health Park Drive) and by the date of execution of <br />this contract the Local Agency (and/or the State) has completed and submitted a preliminary version <br />of a "Scope of Work" describing the general nature of that project work. The Local Agency <br />understands that, before the project work is actually started, the description of the project work in <br />that "Scope of Work" will likely be revised as a result of design changes made by CDOT, in <br />conjunction and coordination with the Local Agency, in its internal review process. The Local <br />Agency desires to agree to perform the project work as described in the "Scope of Work", as it may <br />be revised in that Process. <br /> <br />5. The State's project causes no modification to the Local Agency's route. <br /> <br />6. The State and Local Agency consider it to be in their mutual interest to cooperate in the project. <br />7. The State agrees to modify the design and construction project limits of its project to provide for <br />inclusion of the Work. <br /> <br />8. The Local Agency desires that the State provide design and construction services for the project. <br />9. The Local Agency has made funds available for the extension of the road improvements in <br />Louisville, Colorado, as more specifically described in Exhibit A ("Scope of Work"), and hereinafter <br />referred to as "the project" or "the Work". <br /> <br />10. The Local Agency has funds available and desires to provide 100% of the funding for the Work. <br />11. The Local Agency has estimated the total cost of the Work and is prepared to provide the <br />funding required for the Work as evidenced by the appropriate ordinance or resolution, attached <br />hereto and made a part hereof, duly passed and adopted by the authorized representatives of the <br />Local Agency, which expressly authorizes the Local Agency to enter into this contract and to expend <br />its funds for the Work. If the amount bid is greater then the Local Agency estimate, CDOT will not <br />perform the Work until the Local Agency passes and adopts an appropriate ordinance or resolution <br />to fund the bid amount. If the amount bid is less then the Local Agency estimate, CDOT will <br />perform the Work at the amount that is bid. <br /> <br />12. This contract is executed under the authority of Sections 29-1-203, 43-1-105, 43-2-102 (or 103), <br />43-1-116, and 43-2-101(4)(c), and 43-1-144 C.R.S., as amended, and the Local Agency <br />ordinance/resolution. <br /> <br /> <br />
