In item #4, let me read <br />this to you. Lot Area and Width: No building shall be <br />erected, structurally offered or permitted to remain on <br />the above described real property, unless the ground area <br />provides for such a dwelling, shall consist of up to 7,000 <br />square feet and shall have a width of lot along the minimum <br />building setback line of at least 70 feet. <br /> <br />Davi es: <br /> <br />Did that answer you question? All right. Mr. Chairman? <br /> <br />Ross: <br /> <br />Mr. Davies? <br /> <br />Davies: <br /> <br />I would like to comment on Mr. DiCarlo's statement when he <br />said that the building that he desires is~not even started <br />yet and the one up on Mesa Point was well under way. Which <br />is very true. But as soon as Mr. Ferris' assistant found <br />this error in the prints, he went up and stopped the builder <br />right then. He stopped construction and it took the City, <br />now I'm not going to say who the City is, but undoubtedly <br />it would have to be Mr. Wurl, or the City Manager, or some- <br />one in authority, who told him to continue. Only there was <br />a 1 ittl e bit of a bottl eneck there, too. "You can continue <br />but it will have to go to a variance and if they find you <br />at fault and do not grant your variance, then you will have <br />to cut it out." Now, I'd just like to have that made plain, <br />that we be informed on this part. <br /> <br />Well, my comments on this thing here is I was not present <br />at the last hearing for that application for a variance up <br />around Mesa Point subdivision up there. But it seems to me <br />that we're entering into a personality conflict here. Now, <br />this gentleman is asking for a variance that has nothing to <br />do with the last variance. The variance is what we're here <br />for tonight, and there is no construction going on at the <br />present time in Bella Vista. So I think we're getting a <br />little bit off the track here, okay, we should act from <br />the Variance. Now whatever took place at that last meeting, <br />or the last hearing that was conducted from the City Hall, <br />I don't think this should reflect on this hearing tonight. <br />So, those are my comments on this. Don? <br /> <br />Ross: <br /> <br />Pickett: <br /> <br />Yeah, Don Pickett here. What I have to say is that when <br />we're trying to compare one against the other I think each <br />one of these situations has to be considered on it's indi- <br />vidual merit of the situation that we have before us that <br />evening. There's a big difference between having this room <br />full of people objecting to a situation, and having no one <br />here but the applicant himself. And when we have a group <br />of people and neighbors objecting to, we don't have the <br />same situation we have here and I think we can treat this <br />as the case that we have.here tonight, and the last one <br />over and done with. . <br />
