Factors in Granting of a Variance. <br /> <br />Don Ross says that when a variance comes to the Board, they can use the points <br />in this Section as a guideline, and if they don't agree with any of the points <br />insofar as the application is concerned, maybe that would be a cause for not <br />granting that variance. <br /> <br />Pickett says that it's not anyone of those, it's all of them. <br /> <br />Chairman agrees that all of those, the Board has used. <br /> <br />Reed comments that there is a lot of broad terms in there, and a lot of room <br />for argument. <br /> <br />Ferris says that he thinks it would be a good idea to go through Section 8 <br />at every meeting and go down the line and discuss each individual problem, <br />so the Board would be covered on the tape if their judgement was questioned. <br /> <br />Davies is trying to fit Section 8 into the hearing. He asks if they've <br />satisfied themselves that there are (certain conditions), and then ask the <br />questions if the physical circumstances or conditions exist, and then go <br />right down the list. <br /> <br />Pickett says that if the Chairman would close the Public Hearing with that <br />Section 8 right there - <br /> <br />Ferris comments that he thinks it ought to go up to the applicant so he'll <br />have a chance for rebuttal. <br /> <br />Chairman says that they have to open the Public Hearing with the normal <br />proceedings, and then they go to that <br /> <br />Davies thinks it would be a good idea because if they got a tough case, then <br />they could fill the whole order right there. <br /> <br />4. Section 9. Minutes and Records, Secretary. <br />Steve Ferris, Chief Building Official is thought best for the job of secretary. <br /> <br />5. General Suggestions and Ideas on the By-Laws. <br /> <br />Pickett suggests that if Section 3 and Section 6 were in the opening of the <br />hearing, (the Quorum and the Continuance), and if there were a number of votes <br />necessary and if ther~were only 4 members, and if that were included in the <br />opening of the Public Hearing everyone would be happy, and also if there were <br />only 4 members they could read the continuance. He thinks that it would be a <br />good idea to start it right there, because if there were only 4 members, there <br />might not be a need to go any further. <br /> <br />Ferris suggests typitig,up a guideline. <br />
