Variance Case
Number 1981-1
February 26, 1981

BOARD OF APPEALS AND BOARD OF ADJUSTMENTS MINUTES: PUBLIC HEARING FOR A
VARIANCE FROM THE LOUISVILLE MUNICIPAL CODE, THOMAS A. BOVIO, APPLICANT.
FEBRUARY 26, 1981. PAGE 4.

7. COMMENTS BY STAFF - CONTINUED:

d. Chairman Ross wants to know if the Scenic Heights Subdivision
is in the new section of Town.
1. Ferris replies that it is in a newer section of town.

8. SUMMARY BY APPLICANT - QUESTIONS TO APPLICANT - CONTINUED:

A. Reed would like to know more about the width of the garage.
1. Bovio replies that the reason for the 15 feet in width would be
to allow first of all on each side of the 12 foot door enough
space for the supporting structures. Bovio would also just
like to take advantage of as much room as there is available
to allow room for his truck inside of the garage. He also
believes that with the plans submitted with the application
do not show a door between the garage into the house, and
that was one reason for eliminating the walk-in door in the
front. A swinging door leading into the garage would take
up to 2~ to 3 feet of space, so they would need room to be
able to swing that door open and still have room for the
vehicles inside the garage.
a. Davies asks does that mean that they disregard the numbers
on the setback?
1. Reed explains that you only disregard what he's doing
to the front of the house, that it doesn't make any
difference as to what kind of variance he's applying
for, which is changing a 7 foot setback to a 5 foot
setback.

9. CHAIRMAN CLOSES PUBLIC HEARING.

A. Chairman Bob Ross closes the Public Hearing.

10. COMMENTS BY BOARD MEMBERS.

A. Chairman Ross wants the Board to take a look at Page 443, Line 5,
in the Louisville Municipal Code for this particular variance. Line
5 states, "That the variance, if granted, will not alter the essen-
tial character of the neighborhood or district in which the property
is located, or substantially or permanently affect the use or the
development of the adjacent property". Are there any further
questions from the Board?
B. There were no further statements from the Board.
