A request to rezone Lots 3 - 9 from single-family rural (SF-R) to <br />single-family medium density (SF-MD). The request also includes a preliminary <br />subdivision plat and a preliminary planned unit development (PUD) plan for a total of <br />25 single-family lots. Lots 1 and 2, approximately 4.9 acres, are planned to be <br />dedicated to the City of Louisville's Open Space program and are not part of the <br />rezoning request. Lots 1 - 2, Gateway Subdivision; Southwest comer of South <br />Boulder and McCaslin Blvd and Lots 3 - 9, Gateway Subdivision; Southeast comer <br />of South Boulder Rd and McCaslin Blvd. (Continued from August 10, 2006.) <br />Applicant and Owner: McStain Neighborhoods <br />Representative: Colleen L. Agenda was <br />posted as required on September 15, 2006. <br /> <br />Conflict of Interest and Disclosure: <br />Sheets disclosed that the state agency she works for had previously taken an enforcement action <br />against McStain and she was involved in the case. <br /> <br />Staff Report of Facts and Issues: <br />Lipton noted the additional email regarding the case that had been submitted since the <br />distribution of the meeting packets. Pritchard moved and Loo seconded a motion to enter the <br />email into public record. Motion passed by voice vote. <br /> <br />McCartney reviewed the 5 items that had been identified by the Planning Commission at the <br />August 10, 2006 public hearing as follows: <br />1) Density - discussed Area 7 of the Comprehensive Plan with the following points: <br />a. Low Density would allow 3.5 - 5.0 du/acre. <br />b. Surrounding properties have this average square footage: Hillsborough West is <br />7,000 - 9,000 SF per lot and Continental View Estates is 16,000 SF lots. <br />c. Gateway lots are planned at 10,000 - 12,000 SF lots, which afford a good <br />transition between the two neighboring subdivisions. <br />d. There is a 36% open space dedication and that does not include the 5 acres to the <br />west of McCaslin. <br />2) Traffic - eight alternate access designs have been reviewed by staff with the conclusion <br />that the originally planned full movement is the best option; provides full movement and <br />has the least impact to the neighborhood. <br />3) Landscaping - will be discussed by the applicant. <br />4) Architecture - will be discussed by the applicant. <br />
