InCity,f <br />Louisville <br />COLORADO • SINCE 1878 <br />ITEM: <br />PLANNER: <br />REQUEST: <br />Planning Commission <br />Staff Report <br />October 10, 2024 <br />LMCA-000524-2024 — Amendment to the Zoning Ordinance <br />to comply with Senate Bill SB 23-290 related to the regulation <br />and legalization of Natural Medicine. <br />Matt Post, Senior Planner <br />Approval of Resolution 11, Series 2024 recommending to the <br />City Council approval of an ordinance amending Title 9 and <br />Title 17 of the Louisville Municipal Code (LMC) to allow and <br />regulate Natural Medicine Businesses. <br />SUMMARY: <br />In November 2022, Colorado voters passed Proposition 122, a citizen initiative that, <br />along with SB 23-290, decriminalized the personal possession, cultivation, sharing, and <br />use of psilocybin and similar substances for individuals aged 21 and older. The new <br />State law designates these and related substances as "Natural Medicine." <br />This new State law also allows for the supervised use of Natural Medicine at licensed <br />facilities referred to as "Natural Healing Centers". A Natural Healing Center allows a <br />licensed "facilitator" to administer Natural Medicine in a controlled setting. This law also <br />permits the operation of other "Natural Medicine Businesses" that are engaged in the <br />cultivation, manufacture, and testing of Natural Medicine. <br />This law states that a local jurisdiction may not prohibit Natural Medicine Healing <br />Centers and Natural Medicine Businesses. However, a local jurisdiction may reasonably <br />regulate the time, place, and manner of operation of these businesses. <br />The State has drafted a more detailed set of regulations for Natural Medicine <br />Businesses and facilitators, focusing on licensing, certification, and safe practices. <br />Additional information is attached to this staff report, including the SB 23-290 Summary <br />(Attachment C), and the State's Natural Medicine Know the Law brochure <br />(Attachment D). <br />Staff presented a discussion and direction memorandum to City Council on September <br />3, 2024, to inform City Council of our obligations as a jurisdiction under SB 23-290 and <br />receive feedback and direction in preparation for this draft ordinance. This staff report <br />and the accompanying draft ordinance (Attachment B) are reflective of the direction <br />that staff received from City Council. <br />BACKGROUND AND ANALYSIS: <br />Under this law, Natural Medicine includes psilocybin/psilocyn and, if approved by the <br />State under ongoing rulemaking, may also include dimethyltryptamine (DMT), ibogaine, <br />1 <br />
