RESOLUTION NO. 44 <br />SERIES 2024 <br />A RESOLUTION IN SUPPORT OF A REGIONAL TRANSPORTATION DISTRICT <br />BALLOT MEASURE TO BE SUBMITTED TO THE VOTERS AT THE NOVEMBER 5, <br />2024 ELECTION <br />WHEREAS, the Regional Transportation District (RTD) provides critical services as a <br />public transit provider for Louisville as well as part or all of eight counties and 31 <br />municipalities in the Denver -Boulder metro area; and <br />WHEREAS, public transit and the services provided by RTD are critical to meeting <br />many of Louisville and our region's and state's goals, including (1) providing affordable, <br />equitable transportation options that advance access to opportunity by providing access <br />to jobs, school, medical appointments, and other services; (2) contributing to the <br />county's and state's efforts to achieve their air quality, climate, and affordable housing <br />goals; (3) providing affordable transportation options for seniors, people with disabilities <br />and lower income residents; and <br />WHEREAS, the RTD board of directors has submitted a question to the eligible electors <br />at an election to be held on November 5, 2024 that, without imposing any new tax or <br />increasing any tax rate, RTD is authorized to continue to collect, retain, and spend all <br />revenues it receives from whatever sources without regard to the limitations set forth in <br />the Taxpayer's Bill of Rights (TABOR) in Article X, Section 20 of the Colorado <br />Constitution (the Ballot Measure); and <br />WHEREAS, in 1999, voters exempted RTD from TABOR's revenue and spending <br />limitations through the period required to pay certain bond debt; and <br />WHEREAS, RTD will pay off this bond debt in November 2024; and <br />WHEREAS, such debt payoff will subject much of RTD's TABOR -applicable revenue, <br />except the .4% sales and use tax levied for RTD's FasTracks Project, to TABOR's <br />growth limitations beginning in 2025; and <br />WHEREAS, TABOR growth limitations will limit the annual allowable growth in RTD's <br />revenue collection beginning in 2025; and <br />WHEREAS, TABOR limits do not account for the rate of construction cost increases, <br />which have exceeded Consumer Price Index values, and revenue collected in excess of <br />these TABOR limits must be returned to taxpayers; and <br />WHEREAS, the language of the Ballot Measure is attached to this Resolution as Exhibit <br />A. <br />Resolution No. 44, Series 2024 <br />Page 1 of 3 <br />
