WHEREAS, the City Council recognizes those persons whose homes <br />were damaged or destroyed by the Marshall Fire have suffered <br />great tosses and it is the policy of the City to assist and encourage <br />these residents to rebuild within the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL. OF THE <br />CITY OF LOUISVILLE. COLORADO: <br />Section 1. Section 15.18.010.(b)(3) of the Louisville Municipal <br />Code is hereby amended to read as follows (words to be added un- <br />derlined, words to be deleted stricken): <br />(3) The building permit application was filed on or before Decem- <br />ber 31. 2025 December 31, 2028. and <br />Section 2. If any portion of this ordinance is held to be invalid for <br />any reason, such decision shall not affect the validity of the remain- <br />ing Portions of this ordinance. The City Council hereby declares <br />that it would have passed this ordinance and each part hereof irre- <br />spective of the fact that any one part be declared invalid. <br />Section3. The repeal or modification of any provision of the <br />Municipal Code of the City of Louisville by this ordinance shall not <br />release, extinguish. alter, modify.. or change in whole or in part any <br />penalty, forfeiture. or liability, either civil or criminal, which shall <br />have been incurred under such provision, and each provision shall <br />be treated and held as still remaining in force for the purpose of <br />sustaining any and all proper actions, suits, proceedings, and pros- <br />ecutions for the enforcement Of the penalty, forfeiture, or liability, <br />as well as for the purpose of sustaining any judgment, decree, or <br />order which Can or may be rendered, entered, or made In such ac- <br />tions, sults, proceedings, or prosecutions. <br />Section*, All other ordinances or portions thereof Inconsis- <br />tent or conflicting with this ordinance or any portion hereof are <br />hereby repealed to the extent of such inconsistency or conflict. <br />Section 5. The City Council herewith finds, determines and declares <br />that this ordinance is genuinely and urgently necessary for the im- <br />mediate preservation of the public health, safety, and welfare due <br />to the impacts of the Marshall Fire set forth herein. <br />INTRODUCED, READ, PASSED ON FIRST READING AND OR- <br />DERED PUBLISHED this 4th day of November 2024, <br />Christopher M.
