RESOLUTION NO. 8 <br />SERIES 1999 <br /> <br /> A RESOLUTION APPROVING <br /> A FINAL PUD DEVELOPMENT PLAN <br /> FOR LOTS 4, 5 AND 6, BLOCK 5, <br />COLORADO TECHNOLOGICAL CENTER (CTC), FIRST FILING <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for a 91,216 square foot one and two-story, <br />speculative light industrial building on Lots 4, 5, and 6, Block 5, CTC First Filing; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, related policies and previous approvals; <br />and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan, the Planning Commission recommended approval to the City Council, with <br />conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to the Planning <br />Commission's conditions and City Council finds that said Final PUD Development Plan should <br />be approved, with the following conditions: <br /> <br />That a Covenant Agreement holding these lots as one for building code, drainage and zoning <br />code purposes is recorded with Boulder County prior to the issuance of any building permits <br />for this project; <br /> <br />2. That the final design of the western of the three curb cuts off Boxelder is subject to Staff review <br /> and approval; <br /> <br />3. That two additional street trees are provided, one at both the far east and far west property <br /> lines; <br /> <br />That the following rooftop mechanical unit criteria are added to the PUD, substituting for the <br />existing note on the cover sheet: <br />a) All RTUs shall be set back a minimum of l0 feet from adjacent exterior building wall(s). <br />b) All RTUs that are not fully screened by the building parapet or other approved building <br />element shall be painted to match the adjacent exterior building wall. <br />c) RTUs that extend above the parapet and are not entirely self-contained, 'clean' box units <br />(as determined by Staff), shall be screened to their full height by an architecturally integrated <br />screening material to be specified and approved on the PUD. <br />d) RTUs that extend more than two feet above the parapet, regardless of RTU design or color, <br />may be required to be screened, subject to Staff determination based on the design of the unit <br />and the potential visual exposure from adjacent streets and private property. <br /> <br /> <br />
