<br /> City Council <br /> Meeting Minutes <br /> September 19, 2006 <br /> Page 10 of 10 <br /> City Manager Simmons reviewed the Home Rule Charter with respect to <br /> executive sessions to discuss personnel matters. He noted the City Council may <br /> call an executive session on personnel matters concerning officials directly <br /> appointed by the City Council. He requested City Attorney Light clarify the <br /> requirements of the Home Rule Charter with regard to executive sessions on <br /> other personnel matters. <br /> City Attorney Light explained the Charter provision is the first controlling <br /> document. The City Council may call an executive session on personnel matters <br /> but only involving the performance of an employee directly appointed by the City <br /> Council, or consideration of complaints or charges against those persons or other <br /> personnel matters only upon the request of the City Manager or Mayor, for <br /> informational purposes only. He stated there are restrictions in the Charter and <br /> in the State of Colorado Open Meetings Law, in the exact nature of the <br /> discussion of a personnel matter in executive session. <br /> Council member Sackett asked whether the organizational chart could be <br /> reviewed in an executive session or if there was a requirement for discussion at <br /> an open meeting. City Attorney Light stated he would research the statute. <br /> COUNCIL COMMENTS AND COMMITTEE REPORTS <br /> Mayor Sisk thanked Council members for attending the joint meeting with the <br /> Boulder Valley School District. He stated it is Council's intent is to pass a <br /> resolution in support of the Boulder Valley School Board bond issue. He <br /> reminded Council of the meeting with Boulder County Commissioners on <br /> September 28 on TIF financing on the Urban Renewal Plan. <br /> ADJOURN <br />
