RESOLUTION NO. 44 <br />SERIES 1998 <br /> <br /> A RESOLUTION APPROVING A <br /> FINAL PUD DEVELOPMENT PLAN <br />FOR LOT 3, CENTENNIAL VALLEY PARCEL 0, FILING NO. 7, <br /> KOHL'S DEPARTMENT STORE <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council by CLC Associates, <br />Inc. a Final PUD Development Plan for Lot 3, Centennial Valley Parcel O, Filing No. 7, for <br />Kohl's Department Store; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found in compliance with the Louisville zoning <br />ordinances, subdivision regulations, and related policies; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan, the Planning Commission conducted a public hearing and forwarded a <br />recommendation of approval to the City Council; and <br /> <br /> WHEREAS, the City Council finds that said Final PUD Development Plan as revised <br />should be approved, with the following conditions: <br /> <br />In lieu of compliance with CDDSG minimum landscape requirements, the applicant shall <br />receive authorization of the requested open space credit. <br /> <br />The landscape plan shall be revised to add six additional evergreen trees in Lot 11 where <br />the parking lot is immediately adjacent. <br /> <br />Prior to any conveyance of Lot 12, the applicant shall grant to the City perpetual <br />easement(s) for public way necessary to establish an unobstructed 60-foot public way/yard <br />area adjacent to the north building elevation, in a form acceptable to the City Attorney. <br /> <br />A revised photometric shall be submitted and approved by staffprior to building permit <br />issuance. The photometric and PUD site plan shall be revised to provide low level, <br />bollard, pedestrian scale lighting the entire length of the pedestrian walkway located in <br />the west parking lot, and also around the gazebo amenity. <br /> <br />o <br /> <br />The PUD shall be revised to reflect maximum sign letter heights of 4 feet for the west <br />building elevation, and S feet for the south building elevation. <br /> <br /> <br />
