The applicant shall grant by separate instrument a deed of easement granting to the City <br />an additional four feet of width to the existing 20' wide utility easement located adjacent <br />to the west property line. The applicant shall provide an executed deed to the City at or <br />prior to the recording of the PUD Development Plan. <br /> <br />That the applicant/owner agrees to formalize the commitment to participate in possible <br />future funding of McCaslin Interchange improvements, imcluding acknowledgment that they <br />will not protest inclusion in a possible special improvement district on grounds that their <br />proerty does not benefit by such improvements, with language to be incorporated onto the <br />PUD and in a developer's agreement that is subject to approval by the City Attorney, City <br />Administrator and Mayor. <br /> <br />7. <br /> <br />The applicant shall work with staff to revise the PUD landscape plan to incorporate <br />landscaping along the east side of the retaining wall, between the wall and the fence, as <br />approved by staff. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve an Amendment of a PUD Development Plan for Lot <br />4A, Century Office Park. <br /> <br />PASSED AND ADOPTED this 7th day of July 1998. <br /> <br /> Tom ~avidson, May~ <br /> City of Louisville, Colorado <br /> <br />Dave Clabots, City Clerk <br /> <br />2 <br /> <br /> <br />
