RESOLUTION NO. 22 <br />SERIES 1998 <br /> <br />A RESOLUTION APPROVING A PROPOSED INTERGOVERNMENTAL <br />AGREEMENT AMONG THE CITY OF LOUISVILLE, COLORADO, THE <br />LOUISVILLE HOUSING AUTHORITY, THE COUNTY OF BOULDER AND <br />THE HOUSING AUTHORITY OF BOULDER COUNTY. <br /> <br /> WHEREAS, pursuant to Colorado Constitution Article XIV, <br />Section 18(2) (a) and C.R.S. S29-1-201, et seq., the City of <br />Louisville ("City") may cooperate or contract with other political <br />subdivisions to provide any function, service, or facility lawfully <br />authorized to each; and <br /> <br /> WHEREAS, pursuant to C.R.S. §29-4-101, et seq., the City is <br />authorized to acquire by purchase any property which it may deem <br />necessary for any housing project being constructed or operated by <br />a government or authority; to exercise other powers in respect to <br />housing projects; and to do all acts and things necessary or <br />convenient to carry out such powers expressly given it; and <br /> <br /> WHEREAS, the Louisville Housing Authority, the County of <br />Boulder, and the Housing Authority of Boulder County are vested <br />with similar authorities and powers pursuant to law; and <br /> <br /> WHEREAS, an intergovernmental agreement has been proposed <br />among the City, the Louisville Housing Authority, the County of <br />Boulder, and the Housing Authority of Boulder County respecting <br />certain property located within the City, described as Lots 1-12, <br />Louisville North Filing No. 6, and commonly known as Regal Place <br />and Regal Court; and <br /> <br /> WHEREAS, the City Council finds the proposed intergovernmental <br /> agreement is in the best interests of the City and its citizens. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OFT HE CITY <br /> OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Regal Court/Regal Place Intergovernmental <br /> Agreement ("Agreement"), a copy of which is attached hereto and <br /> incorporated herein by this reference, is hereby approved. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached <br /> Agreement on behalf of the City Council of the City of Louisville, <br /> except that the Mayor is hereby further authorized to negotiate and <br /> approve such revisions to the Agreement as the Mayor determines are <br /> necessary or desirable for the protection of the City, so long as <br /> the essential terms and conditions of the Agreement are not <br /> altered. <br /> <br /> 3. The Mayor, City Clerk, City Administrator and City staff <br /> are further authorized to do all things necessary on behalf of the <br /> City to perform the obligations of the City under the Agreement, <br /> <br /> <br />
