A. The Authority may rehear a previously granted or denied application and <br /> may modify its decision thereon only if: <br /> (1) The hearing is conducted and the decision modified at a time prior <br /> to the date an appeal of the initial decision must be perfected pursuant to <br /> C.R.C.P. 106(a)(4); and <br /> (2) There has been a substantial change in the facts or law subsequent <br /> to the initial hearing. <br /> B. Prior to any rehearing, the Authority shall cause proper notice thereof to <br /> be given to the parties and the public. <br /> Section 10. Order of Hearings. The order of the hearing shall be as follows <br /> unless revised by the Authority by vote at the hearing: <br /> A. Chair opens public hearing. <br /> B. Opening Statement by Chair. The Chair shall state the purpose of the <br /> hearing and generally describe the procedure for conducting the hearing. <br /> C. Authority member disclosures, if any. <br /> D. The Secretary shall present the Secretary's report, summarizing the <br /> application, the documents accompanying it, the results of any City investigation, and <br /> the notice given. <br /> E. Reports of representatives of City departments or other governmental <br /> agencies, if any. <br /> F. Applicant's presentation to the Authority and Applicant's witnesses. The <br /> Authority, Authority attorney, and parties in interest opposed to the application may <br /> question the Applicant and any of the Applicant's witnesses. <br /> G. Statements to the Authority by other parties in interest in favor of the <br /> application. The Authority, Authority attorney, and parties in interest opposed to the <br /> application may question those making statements to the Authority in favor of the <br /> application. <br /> H. Statements to the Authority by parties in interest opposed to the <br /> application. The Authority, Authority Attorney, the Applicant and other parties in interest <br /> who favor the application may question those making statements to the Authority <br /> opposed to the application. <br /> Rebuttal by Applicant.
