A one -year extension of <br />approval time may be applied for in writing to the planning commission." <br />Planning Commission <br />2270 South 88th Street <br />March 10, 2011 <br />The applicant has requested a one year extension of the expiration of a preliminary <br />subdivision plat and preliminary planned unit development (PUD) plan for 2270 South 88th <br />Street. The preliminary plat and preliminary PUD plan were originally approved by City <br />Council on April 6, 2010. Section 16.12.030.(E) (Preliminary plat— Processing) of the <br />Louisville Municipal Code (LMC) states: <br />Section 17.28.170.(D) (Preliminary development plan - -Plan review) of the LMC states: <br />"Approval of the application shall constitute approval of the preliminary development plan and <br />shall be valid for one year. A one -year extension of approval time may be applied for in writing to <br />the planning commission... " <br />The above sections of the LMC do not permit the granting of vested rights and do not <br />allow the applicant to proceed to the final subdivision plat and final development plan <br />stage of the approval process for the 2270 South 88th Street project (ConocoPhillips) <br />after April 6, 2011. An extension of the preliminary plat and preliminary development <br />plan expiration dates must be granted in order for the applicant to proceed to final <br />subdivision plat and final development plan after April 6, 2011. <br />Due to the scale of the project, the one year extension to April 6, 2012 has been <br />requested to provide the applicant sufficient time to complete internal reviews and <br />submit the final development plans for approval (see applicant's letter). <br />The preliminary plat and preliminary PUD plan for 2270 South 88th Street was <br />approved by City Council in April 6, 2010 and was summarized in the February 11, <br />2010 staff report as follows: <br />The ConocoPhillips is requesting authorization of the required land -use entitlements to develop a <br />390 acre campus with a total build out of 2.5 million square feet. The integrated campus will be <br />comprised of four major land uses including a corporate learning center, a global technology <br />center, general offices, and noncommercial support services for employees and guests. <br />Development of the campus will be in three phases. Phase 1 will construct approximately 1.6 <br />million square feet with initial occupancy scheduled for 2013; the remaining .9 million square feet <br />will be divided between Phases 2 and 3 with the initial occupancy of Phase 2 scheduled for 2018 <br />and build out estimated for 2032. The campus will be located on land that was formerly occupied <br />by the StorageTek Corporation. The following table provides a comparison between the <br />previous StorageTek campus and the proposed ConocoPhillips campus. <br />* 2.5 million SF is total build out. Phase I is for 1.6 million SF. which mirrors the StorageTek development that <br />existed on the property prior to demolition. Phase I will be a total of 9.4% FAR. <br />Page 12 of 27 <br />
