SIMMONS <br /> CITY MANAGEf~ <br />DATE: January 12, 2004 <br />SUBJECT: Organizational Items <br />ORIGINATING DEPARTMENT: Ci~f Manager's Office <br />SUMMARY: <br />Most items on this agenda are self-explanatory, however there are a few that may be <br />confusing. <br />Items IV. and V. <br />Prior to the adoption of the Home Rule Charter, the Municipal Code stated that Council <br />members would take office "commencing on the first Monday after the first Tuesday in January <br />following their election." (Sec. 2.36.0'10). The Home Rule Charter states that "(t)he Mayor and <br />each Councilmember shall take offiCE~ at the first regular meeting of the Council following their <br />election..." (Sec. 3-4(b)). Changes from the Home Rule Charter become effective at the <br />November, 2005 regular election, malking this the last time the organizational meeting will be <br />held in January. <br />Item VII I <br />The appointments of the Municipal Judge and Deputy Municipal Judge will be for two (2) year <br />terms which will expire at the first regiular meeting in January, 2005. Although the Home Rule <br />Charter states that "the initial appointment may be for a term which expires on the date of the <br />next regular election" (Sec. 9-3(b)), the mayor elect has recommended to retain the January <br />expiration date. Please note that the Municipal Judge (and the Deputy Municipal Judge) may <br />not be removed during their terms except for cause and by a two-thirds vote of the entire <br />Council, a provided for in Sec. 9-3(e) of the Home Rule Charter. <br />The City Attorney, Prosecuting Attorney and Water Attorney are appointed once by the City <br />Council, then serve at the pleasure of the Council until they are removed. Since they have <br />been appointed previously, they are not being sworn into office at this meeting. <br />Item IX. <br />The Home Rule Charter states that the terms of the City Treasurer and the City Clerk "shall be <br />abolished at the conclusion of the term of office being served... on the effective date of this <br />Charter". (Sec. 17.4(c) and (d)). As the Treasurer and Clerk were both elected to four-year <br />terms in 2000, those positions as elected offices have been abolished.
