<br />of the Telecommunications Act of 1996 (Public Law 104-104) . <br /> <br />Section 3. Upon the effective date of this ordinance, and <br />until August I, 1997, no building permit or other application for <br />the placement, construction or modification of wireless <br />telecommunication service facilities within the City limits of the <br />City of Louisville shall be reviewed, approved, issued, or <br />otherwise acted upon, unless otherwise provided in this ordinance. <br /> <br />Section 4. The restrictions contained in this ordinance <br />shall not apply to any building permit or other application for the <br />placement, construction or modification of wireless <br />telecommunication facilities which are to be publicly owned and <br />operated facilities necessary for the public health, safety and <br />welfare, including but limited to, police, fire, and emergency <br />service facilities. <br /> <br />Section 5. <br />in nature and <br />enactment. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each <br />part hereof irrespective of the fact that anyone part be declared <br />invalid. <br /> <br />Section 8. The repeal or modification of any provision of <br />the Municipal Code of the City of Louisville by this ordinance <br />shall not release, extinguish, alter, modify, or change in whole or <br /> <br />4 <br />
