Planning <br />Director Wood explained it does not apply to the Old Town commercial overlay, however <br />it does apply to residential and mixed use development. <br /> <br />Mayor Sisk stated the ordinance allows developers to come forward and it provides <br />some level of predictability. He voiced his support of the ordinance. He requested public <br />comments and hearing none, closed the public hearing. <br /> <br />MOTION: Council member Sackett moved to approve Ordinance No. 1513, Series <br />2007, seconded by Council member Muckle. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br /> <br />ORDINANCE No. 1514, SEl"tlES 2007 - AN ORDINANCE AMENDING SECTION <br />2.80.030 OF THE lOUISVlllE MUNICIPAL CODE BY ADDING SECTION 2.80.030. A <br />(5), PERTAINING TO GIFT BANS AND APPLICATION OF THE CODE OF ETHICS TO <br />INDEPENDENT CONTRACTORS OF THE CITY - 2nd reading - Public Hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1514, Series 2007. He explained at the <br />February 20, 2007 City Council meeting a resolution affirming the City's Code of Ethics, <br />in light of Amendment 41, was unanimously passed by City Council. City Council <br />directed Staff to prepare an ordinance to expressly extend the Code of Ethics gift ban to <br />apply to official actions beyond contract matters, and to certain independent contractors. <br />Ordinance No. 1514, Series 2007 amends Section 2.80.030.A of the Louisville Municipal <br />Code by adding language pertaining to gift bans and application of the Code of Ethics to <br />independent contractors of the City. <br /> <br />Mayor Sisk opened the public hlearing and requested public comment. There were no <br />comments. <br /> <br />COUNCIL COMMENT <br /> <br />Mayor Sisk inquired whether an independent contractor would be prohibited from <br />accepting gifts from other firms contracting with the City. <br /> <br />City Attorney Light stated gifts from an independent contractor would not be prohibited if <br />the City was not actively participating in negotiations with those firms, or if there was a <br />long standing personal relationship that predates the contract with the City. Likewise, if <br />one independent contractor is not involved in negotiations in other City contracts, there <br />would be no prohibition. <br /> <br />Council member Muckle stated the Ordinance is well drafted to prohibit gifts for the <br />purpose of influencing public officials. <br />
