All were in favor. <br /> ORDINANCE No. 1606, SERIES 2011 — AN ORDINANCE AMENDING <br /> CHAPTER 15.36 OF THE LOUISVILLE MUNICIPAL CODE REGARDING THE <br /> PROCEDURES APPLICABLE TO DEMOLITION REVIEW OF BUILDINGS <br /> THAT ARE OVER FIFTY YEARS OLD —2ND Reading — Public Hearing <br /> Mayor Muckle requested a City Attorney introduction. <br /> City Attorney Light Read Ordinance No.1606, Series 2011. <br /> Mayor Muckle opened the public hearing and requested a staff presentation. <br /> Principal Planner McCartney explained the ordinance amends Chapter 15.36 of the <br /> LMC regarding demolition review of buildings and clarifies the definition of walls, <br /> windows and doors. In Section 15.36.020.c.1 of the LMC there is no definition for <br /> "exterior wall finish" therefore, it is left up to interpretation and may be interpreted to not <br /> include windows or doors. To eliminate the need for interpretation as to whether <br /> windows and doors are considered an "exterior wall finish", staff recommended LMC <br /> Section 15.36.020.c.1 be amended to include the following: "The wall shall retain studs <br /> or other structural elements, the exterior wall finish, windows (which includes glazing, <br /> framing, sill, sash, and muntins), doors, and the fully framed and sheathed roof above <br /> that portion of the remaining building to which such wall is attached." <br /> The regulatory language of Sec. 15.36 establishes all historic structures slated for <br /> demolition anywhere in the City must first apply for a demolition permit with the Building <br /> Safety Division. The Historic Preservation Commission and Staff request Council <br /> consider minor modifications to Section 15.36 to clarify the specific demolition request <br /> review procedures and the demolition permit eligibility timeframes.
