City Council <br /> Meeting Minutes <br /> December 6,2011 <br /> Page 7 of 14 <br /> permit is issued, the applicant has 180-days to begin the project. The 180-day time <br /> period is required in the 2009 IBC, which revokes a building permit if no activity has <br /> taken place within 180-days after issuance of the permit. The Building Safety Division <br /> cannot "issue" a permit without acceptance and payment for the permit from the <br /> applicant; therefore, if the permit has not been paid for by the applicant, then all "other <br /> requirements" of the permit have not been met. <br /> IBC Section 105.3.2 Chapter 1 addresses time limits or expiration of dormant permits. <br /> "The building official is authorized to grant one or more extensions of time for additional <br /> periods not exceeding 90 days each. The extension shall be requested in writing and <br /> justifiable cause demonstrated." The HPC's primary issue with the above language is <br /> the statement "the building official is authorized to grant one or more extensions of <br /> time". They believe this is an open ended statement which could extend any given <br /> permit for an immeasurable amount of time. Staff and the HPC want to create a process <br /> for a formal time frame and deadline for which demolition permits must be used, <br /> otherwise they will be deemed null and void. This amended requirement will eliminate <br /> the possibility for the issuance of dormant permits. <br /> LMC Section 15.36.200 provides a 180 day time frame for which a demolition permit <br /> must be acted upon once issued. The purpose of this language is to create a time limit <br /> for which an applicant must take action before a demolition permit is considered void. <br /> Once considered void, the applicant would need to reapply and go through the process. <br /> Staff recommended language to amend the current language: <br /> Staff recommended approval of Ordinance No. 1606, Series 2011, and amendments to <br /> Section 15.36.200 of the Louisville Municipal Code (LMC), with the following condition: <br /> 1. Modify Section 15.36.200.M to state "Further, if the building permit requested <br /> within such one-year period is not consistent with the property owner's written <br /> explanation and/or drawings of the plan for the building, a new demolition review <br /> shall be required." <br /> PUBLIC COMMENTS <br /> Peter Stewart, 1132 Jefferson Avenue, Louisville, CO, representing the Historic <br /> Preservation Commission, voiced support for the proposal. They feel this will match with <br /> the intent of the ordinance. The HPC also feel it should be tied to the property owner <br /> because the landmarking program is on a volunteer basis and a decision has to be <br /> made by the property owner. He urged Council to approve Ordinance No.1606. <br /> COUNCIL COMMENTS <br />
