<br />City Council <br />Meeting Minutes <br />April 19, 2005 <br />Page 6 of 11 <br /> <br />1) based on a surveying error in the past, it was believed the right-of-way would <br />be needed to extend the planned Spruce Street road alignment; or 2) there were <br />plans for Spruce Street to become a major throughway, requiring an <br />appropriately wider right-of-way. Staff has not identified any existing or future <br />public purpose that would be served by the property and there are no <br />foreseeable plans for an expansion of Spruce Street. <br /> <br />Staff has requested a small (5-foot by 60-foot) strip of land at the northeast <br />corner of the right-of-way be reserved for public right-of-way to preserve the <br />ability to move traffic control signage and potentially a fire hydrant back behind <br />the sidewalk. <br /> <br />Mayor Sisk requested an Applicant presentation. <br /> <br />Rick Lucky, 101 W. Spruce Street, Louisville, CO reviewed the history of his <br />ownership of the property and his knowledge of the adjacent street right-of-way. <br /> <br />Council member Keany asked the Public Works Director if the City has any future <br />use for the right-of-way. Public Works Director Tom Phare responded no. <br /> <br />Mayor Sisk asked City Attorney Light if Mr. Lucky could get quit title to the <br />property and then quit claim the 240 square feet to the City. City Attorney Light <br />stated the ordinance could be modified to add language, which would provide for <br />Mr. Lucky to take title of the property and deed 240 SF back to the City. <br /> <br />Mayor Sisk asked if Mr. Lucky was willing to work with the City Attorney's office. <br />Mr. Lucky stated his willingness. <br /> <br />Mayor Sisk requested public comment and hearing none, closed the public <br />hearing. <br /> <br />MOTION: Mayor Sisk moved for Council approval of Ordinance No. 1467, Series <br />2005, with language added in Section three, whereby Mr. Lucky would proceed <br />with the quit title, and work with the City Attorneys to deed 240 SF back to the <br />City. Council member Marsella seconded the motion. Roll call vote was taken. <br />The motion carried by a vote of 6-0. Absent - Council member Levihn. <br /> <br />ORDINANCE No. 1468, SERIES 2005 - AN ORDINANCE AMENDING TITLE <br />13, "WATER AND SEWER" OF THE LOUISVILLE MUNICIPAL CODE' <br />ADDING A NEW SECTION 13.08.180, "CROSS CONNECTION CONTROL;" <br />AND SETTING FORTH DETAILS IN RELATION THERETO - 2nd reading- <br />public hearing (advertised Daily Camera 3/26/05) <br /> <br />Mayor Sisk requested a City Attorney introduction. <br />
