Louisville City Council Meeting <br />October 3, 2000 <br />Page 3. <br /> <br />ORDINANCE NO. 1341, SERIES 2000 - AN ORDINANCE ESTABLISHING A <br />PARKING IMPROVEMENT FEE TO ASSIST IN MEETING PARKING NEEDS <br />IN DOWNTOWN LOUISVILLE, AND AMENDING CHAPTER 17.20 OF THE <br />LOUISVILLE MUNICIPAL CODE AND THE LOUISVILLE COMMERCIAL <br />DEVELOPMENT DESIGN STANDARDS TO PROVIDE THAT OFF-STREET <br />PARKING REQUIREMENTS FOR DOWNTOWN LOUISVILLE MAY BE <br />SATISFIED IN WHOLE OR PART BY PAYMENT OF A PARKING <br />IMPROVEMENTS FEE - 2aa reading - public hearing (advertised Daily Camera <br />July 3, 2000) continued from 8/15/00 <br /> <br />Davidson called for City Attorney presentation. <br /> <br />City Attorney Light read Ordinance No. 1341 Series 2000. Light noted that there are <br />second reading amendments to the ordinance that also change the title adding to the end <br />the phrase, "and further defining parking requirements for a freestanding building within <br />downtown Louisville, occupied solely by a restaurant use." <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Wood stated that Council directed Staff to revise Ordinance No. 1341, <br />Series 2000 to reflect the following amendments: <br /> <br />o <br /> <br />Parking requirements for freestanding buildings occupied solely by a restaurant <br />use should be required to provide parking for that floor area designed for public <br />use, excluding floor area within restrooms and floor area designed for service and <br />food preparation staff. <br />Existing approved and recorded PUDs would not need to meet the requirements <br />of this ordinance until October 31, 2002. This part of the ordinance only grants <br />an exception from meeting the requirements of providing parking to the extent <br />that the requirement is not met by the PUD and does not grant other exceptions <br />from zoning regulations. <br />The fee is to be set at $10,500. <br />Language was amended to clarify that the ordinance applies to all constructed, <br />expanded or modified floor area as opposed to interchanging the terms floor area, <br />building and structure. The original intent of Ordinance No. 1287, Series 1998 <br />was to require that all floor area that generates parking, including habitable <br />basement space, shall provide parking (essentially, a gross calculation). Floor <br />area, as defined in the zoning code, reflects the legislative intent of the original <br />parking ordinance. <br /> <br />3 <br /> <br /> <br />
