<br />3. Applications submitted by the administrator <br />upon a determination that the public interest <br />is best served by the public hearing review <br />process. <br /> <br />4. Any other temporary use permit application not <br />meeting the requirements of the administrative <br />temporary use permit process. <br /> <br />S. Upon receipt of a complete temporary use permit <br />application which is subject to subsection A above, <br />the administrator shall forward the application to <br />the city council and planning commission along with <br />a written recommendation relative to the proposed <br />use. Notice that the application will be reviewed <br />pursuant to the public hearing review process and a <br />copy of this recommendation shall be supplied to <br />the applicant at least five days prior to <br />consideration by the planning commission. <br /> <br />T. Within thirty (30) days of receiving the written <br />recommendation of the administrator, the planning <br />commission shall review the application and make a <br />recommendation thereon to city council. Upon <br />receiving the recommendation of planning <br />commission, the city council shall schedule and <br />hold a public hearing on the application. The city <br />council , within thirty (30) days of the public <br />hearing, shall either grant the application in <br />whole or in part, with or without reasonable <br />conditions or modifications, or deny the <br />application. Approval of an application may be <br />granted only if the city council finds the <br />application is complete, and the application and <br />project meets all applicable standards and criteria <br />in this chapter, title 17, and other city <br />ordinances and codes, including adopted building <br />codes and water and sewer ordinances. <br /> <br />Section 3. Any person who violates any provision of this <br />Ordinance shall be punished by a fine of not more than $1,000 or by <br />imprisonment not to exceed 1 year or both such fine and <br />imprisonment. Each day during any portion of which any violation <br />of any provision of this ordinance is committed, continued, or <br />permitted by any such person shall be a separate offense. <br /> <br />Section 4. The City Council herewith finds, determines, <br />and declares that this ordinance is necessary for the preservation <br />of the public health and safety. <br /> <br />11 <br />
