Louisville City Council Meeting
April 17, 2001
Page 6

Susan McEachern, 799 Aspen Way, Louisville, CO, stated that she and her husband
purchased the property in 1999 from Gary Dart. She explained that the property included
the alley rights-of-way. She stated that their goal is to clear the rights-of-way to obtain
title insurance of the whole property, and to pursue their desire to divide their one-half
acre lot into two separate lots. She stated they currently have no plans to develop the
second lot.

Sisk asked if anyone in the audience wished to speak for or against Ordinance No. 1359,
Series 2001. Heating none, Sisk closed the public hearing.

COUNCIL COMMENTS

Sisk stated that it was his understanding that the request did not include any additional
building lots. Wood confirmed that no additional building lots are requested.

Sisk asked Wood about the status of the third alley/easement. Wood stated that the status
of that alley is not being changed.

Sisk asked the applicants if they understood the status of the alley, which will not be
vacated. McEachem stated that the status of that alley is uncertain, and that there is no
historical record on the vacation of that alley. She stated that at some future time, they
would like to explore receiving half of the third alley if it is vacated..

Sisk explained to Ms. McEachern that the surrounding property owner could also use the
alley.

Brown asked if the two lots, Lot 1A and Lot 2A are both owned by the applicant.
McEachem confirmed they own both lots.

MOTION: Howard moved that Council approve Ordinance No. 1359, Series 2001,
seconded by Keany. All in favor.

RESOLUTION NO. 26, SERIES 2001 - A RESOLUTION APPROVING A MINOR
SUBDIVISION PLAT FOR JOHNSON'S FIRST ADDITION, REPLAT A, A
REPLAT OF LOTS 12-14, AND THE SOUTH 90 FEET OF LOT 15, BLOCK B,
JOHNSON'S FIRST ADDITION

Sisk called for Staff presentation.

Planning Director Paul Wood reviewed the background of the subject property is zoned
RL, Residential Low Density and is not part of the Old Town overlay zone district.
