Johnstone stated that he did not know the reason. <br /> <br />Davidson stated that the applicant is being delayed by the Open Space Advisory Board's <br />review and that he was in favor of going forward with setting the public hearing. <br /> <br />MOTION: Keany moved that Council approve Resolution No. 24, Series 2001, <br />seconded by Levihn. <br /> <br />City Attorney Light clarified for the record that the Resolution for Substantial <br />Compliance would set a public hearing date for July 3, 2001. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 4-2. Mayer and <br />Brown voted no. <br /> <br />RESOLUTION NO. 27, SERIES 2001 - A RESOLUTION OF SUBSTANTIAL <br /> COMPLIANCE - HOYLE ANNEXATON <br /> <br />Davidson called for Staff presentation. <br /> <br />Principal Planner Johnstone reported that the property owners, the Hoyle Family Trust, <br />have submitted an annexation petition to commence the annexation process with <br />the City of Louisville. The property is approximately 33.78 acres in area and is located <br />adjacent to the Colorado Technological Center. Johnstone explained that the Resolution <br />of Substantial Compliance represents the first step in the annexation process and is not a <br />decision on the merits of the proposed annexation or rezoning. If authorized by Council, <br />the zoning will come before the Planning Commission at a June meeting. He reported <br />that Staff and the City Attorney's office have reviewed the petition and map and find <br />them, as revised, to be in compliance with statutory requirements. <br /> <br />Johnstone stated that Resolution No. 27, Series 2001, if authorized, would set the public <br />hearing date on the annexation for July 3, 2001. He noted that the property owner is <br />requesting an Industrial (I) zoning in conjunction with the annexation. He stated that the <br />property is subject to an Intergovernmental Agreement, the Southeast Boulder County, <br />South 96 Street, Dillon Road and US 287 Area Comprehensive Development Plan, <br />which designates the parcel as Rural Preservation. If approved, an amendment to the IGA <br />would be required during the public hearing process. The amendment to the IGA would <br />have to be approved by the members of that body. Johnstone reported that Richard <br />Lopez, counsel for the applicant, had another obligation and could not be present. Mr. <br />Lopez has asked that a public hearing be set for July 17, 2001. <br /> <br />6 <br /> <br /> <br />
