<br />STAFF COMMENTS: <br /> <br />Encroachment into Pine Street ROW <br /> <br />The existing right-of-way for Pine Street was originally platted as part of Lots 20 and 21 and were <br />subsequently acquired by the City for right-of-way purposes. Portions of the existing building and <br />part of the porch additions extend into City right-of-way on Pine Street. The existing <br />encroachment is approximately 18 feet long and extends approximately 3 feet into the Pine Street <br />ROW. In addition, there is an approximately 5 foot long chimney that further extends an <br />additional foot into the ROW. The applicant is proposing to build a covered porch, extending this <br />building line approximately 16 to 19 feet towards Main Street. A lease agreement for this existing <br />and proposed ROW encroachment has been drafted and reviewed by City Council at its December <br />6, 1994 meeting. An ordinance approving this lease agreement was approved by City Council on <br />first reading on December 6th. Second reading will be considered by the City Council at the same <br />meeting as this final PUD development plan. <br /> <br />The proposed porch is angled to maintain vision clearance at the intersection. The required vision <br />clearance triangle should be noted on the PUD. <br /> <br />Signs <br /> <br />The following signs are proposed. Two ground mounted signs one facing Main Street and one <br />facing Pine Street. Each will be a maximum of 20 square feet. Three building mounted signs - <br />one 18 square feet and two 8 square feet each. Total proposed sign area is 74 square feet. This <br />is within the allowable area permitted by the zoning ordinance. <br /> <br />STAFF RECOMMENDA TION: <br /> <br />APPROV AL of the Final PUD Development Plan for 641 Main Street with the following <br />conditions: <br /> <br />1. An ordinance approving a lease agreement for the proposed encroachments must <br />be approved by City Council; <br /> <br />2. The vision clearance area shall be shown on the PUD and the proposed porch shall <br />not encroach into the required vision clearance area. <br /> <br />2 <br />
