<br />RESOLUTION NO. 67 <br />SERIES 1994 <br /> <br />A RESOLUTION ACCEPTING A QUIT CLAIM DEED, APPROVING THE <br />EXECUTION OF A DEED OF CONSERVATION EASEMENT AND <br />APPROVING THE EXECUTION OF A LETTER OF UNDERSTANDING IN <br />CONNECTION WITH THE CITY'S SOLE ACQUISITION OF A PORTION <br />OF THE HARNEY/LASTOKA PROPERTY FOR BALL FIELD USE <br />PURSUANT TO THE TERMS OF AN INTERGOVERNMENTAL AGREEMENT <br />AKONG THE CITY OF LOUISVILLE, THE CITY OF LAFAYETTE AND <br />BOULDER COUNTY. <br /> <br />WHEREAS, the City of Louisville, the City of Lafayette, and <br />Boulder County are signatories to the Purchase Agreement, Option to <br />Purchase and Lease dated April 26, 1993 (the "Purchase Agreement") <br />for the Harney/Lastoka Property located at the southeast corner of <br />SH 42 and South Boulder Road; and <br /> <br />WHEREAS, pursuant to the Purchase Agreement, the ci ty of <br />Louisville, the city of Lafayette, and Boulder County have <br />purchased to date two parcels of the HarneyjLastoka Property <br />totaling 89.126 acres commonly known as Parcels 1 and 2; and <br /> <br />WHEREAS, Lafayette, Louisville and Boulder County entered into <br />an INTERGOVERNMENTAL AGREEMENT South Boulder Road Open Space <br />Purchase, recorded on April 29, 1993, in the Boulder County Clerk <br />and Recorder's office on Film 1817 as Reception No. 01287280, in <br />which each party agreed to terms and conditions governing the use <br />and development of the HarneyjLastoka Property and their respective <br />ownership interests and shares in Parcels purchased; and <br /> <br />WHEREAS, pursuant to the terms and provisions of the <br />INTERGOVERNMENTAL AGREEMENT, Louisville is entitled to acquire sole <br />title to a portion of Parcel 1 consisting of 24 acres for ball <br />field use; <br /> <br />WHEREAS, the INTERGOVERNMENTAL AGREEMENT provides that where <br />a party takes sole title to a portion of the property , its <br />proportionate share as a tenant in common of the balance of the <br />remaining property purchased by the parties to date shall be <br />proportionately reduced; and <br /> <br />WHEREAS, in order to effect the provisions of the <br />INTERGOVERNMENTAL AGREEMENT, Lafayette and Boulder County wish to <br />convey their interests in that portion of Parcel 1 by quit claim <br />deed to Louisville for ball field use and Louisville desires to <br />accept such quit claim deed; and <br /> <br />1 <br />
