<br />RESOLUTION NO. 16 <br />SERIES 1994 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION REPLAT FOR TREEHA VEN <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Terese Kristovich <br />a request for approval of a Final Subdivision Replat; and <br /> <br />WHEREAS, all materials related to the Final Subdivision Replat have been reviewed by city <br />staff and the Planning Commission and found to be in compliance with the Louisville zoning <br />ordinances, subdivision regulations, and related policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Replat, the Planning Commission recommended to the City Council approval with conditions; and <br /> <br />WHEREAS, the City Council finds that said Final Subdivision for the Treehaven <br />Subdivision should be approved with the following conditions: <br /> <br />1. Outlot A shall be posted as a "Private Fire Lane" at Spruce <br />Street. <br /> <br />2. A draft of the proposed covenants governing the use and <br />maintenance of Outlot A shall be submitted with the final plat. <br />Covenants and the Treehaven Subdivision Agreement should reflect <br />that maintenance responsibilities for Outlot A shall be by owners <br />of Lots 2 and 3. Covenants shall provide a method for resolving <br />disagreements between the two parties using this driveway. <br /> <br />3. Access to Outlot A shall be limited by subdivision agreement <br />restriction to only Lots 2 and 3. <br /> <br />4. Delete "access" from 25' drainage and utility easement along east <br />boundary . <br /> <br />5. Note "responsibility for maintenance of Outlot B City of Louisville" <br />on final plat. <br /> <br />6. Note "No vehicular access to lot 6 from Pine Street permitted" on <br />final plat. <br /> <br />7. Note "Driveway design for lot 7 shall not require vehicles to back <br />out into Pine Street. " <br /> <br />8. Development shall be in compliance with Resolution No. 36, Series 1993. <br />
