Louisville City Council Meeting <br />September 4, 2001 <br />Page 7 <br /> <br />Keany asked if the 15% land dedication was in addition to construction of a trail. He <br />stated his understanding that the owner, in conjunction with the Parks Department, would <br />design the trail. Mehaffy stated that the owners would make the land available for <br />development. <br /> <br />City Attorney Light noted that Paragraph E, page 5, stipulates that "The Owner receive <br />credit for the trail dedication toward the fulfillment of the required subdivision public <br />dedication requirement." He stated that as currently drafted, the trail is not in addition to <br />the 15% requirement. <br /> <br />Mehaffy asked if the question asked by Mr. Keany was who would construct the trail. <br /> <br />Keany questioned whether the construction of the trail is in addition to the 15% <br />dedication. He noted that in Paragraph E, page 5, stipulates, "The Owner shall design the <br />trail to a sufficient width as determined by the Parks Department." <br /> <br />Mehaffy stated that the Owner would design the trail to the City's requirements. <br /> <br />Keany asked if the Owner would build the trail. He stated that it was his understanding <br />that this was in exchange for the access across the open space easement. He favored <br />owner construction of the trail in addition to the 15% dedication. <br /> <br />Mehaffy stated that he would confer with the owners. <br /> <br />Brown asked if the Agreement with the HOA was not for membership, but compliance. <br />He stated that if the Agreement is satisfactory with the HOA, he did not have a problem. <br />Mehaffy clarified that it includes membership, and is subject to monthly dues and <br />compliance to the HOA guidelines. <br /> <br />Brown stated that given that there has been neighborhood cooperation and alteration to <br />the development plan, he was inclined to vote in favor of the proposal. <br /> <br />Sisk asked about the size of the home. He stated that there were previous discussions <br />relative to the size of the home being commensurate with the balance of the <br />neighborhood. <br /> <br />Mehaffy stated that the home is to be a ranch-style home with a footprint of 3,500 SF, <br />with a garage, and partial basement. <br /> <br />Sisk stated his desire that the annexation specify a maximum square footage. Mehaffy <br />stated that with the living area of the home, basement and garage, the maximum square <br />footage would not exceed 7,000 SF. <br /> <br />7 <br /> <br /> <br />
