Louisville City Council Meeting <br />October 2, 2001 <br />Page 9 <br /> <br />Hine asked how Council plans to explain to citizens why they keep ratcheting up the <br />price of this property; property that the voters may decide to purchase with taxpayer <br />money. Hine stated that the developer of the property is trying to run this application <br />through the process as quickly as possible. Hine stated that the PUD and Subdivision <br />Plat was approved by the Planning Commission only twelve days ago and is already <br />before Council for consideration. Hine stated he had never seen an item move so quickly <br />and suggested that Council consider approval of the PUD contingent on the election <br />results. <br /> <br />JoBelle Fischer greeted Council and stated that she has been very patient, but feels the <br />process has taken a long time. Mrs. Fischer stated that many people have approached her <br />and stated that the CAPPOS group had misled them with misinformation. She stated that <br />she did not feel the City has been dragging their feet. As far as making her property more <br />valuable, Ms. Fischer stated that she disagreed, and that in fact it was unfair to try to <br />devalue her property. She voiced her appreciation of Council's time and requested that <br />they approve the Final PUD and Subdivision Plat. Mrs. Fischer stated that it is time for <br />this matter to be over, and that this whole process has worn on her family and the <br />neighborhood. <br /> <br />COUNCIL COMMENTS <br /> <br />Mayer stated his opinion that the process has been going on for a long time and that there <br />have been divided opinions on this issue. He continued that the PUD presented is faithful <br />to the Annexation Agreement, and that what is guaranteed as the value of the land, is <br />contained in the Annexation Agreement, as opposed to what is guaranteed in the PUD. <br />Mayer stated that the only expense to taxpayers will be based on the outcome of the <br />election. Her continued that the neighborhood has reached a compromise in this matter <br />and that the community is gaining approximately 3-acres of park land. He commented <br />that one of his major concerns was that the PUD remain faithful to the Annexation <br />Agreement. The other concern, that the relief being requested is reasonable. Mayer <br />declared support for the PUD and stated that the City should keep its part of the <br />agreement. <br /> <br />Howard stated that in such situations, it is impossible to satisfy all of the citizens. <br />Howard stated that he lives near the Fischer property, and though he is not directly <br />involved, feels a park in the area is greatly needed. Overall, the compromises <br />reached and good faith demonstrated by the developer lead him to support the PUD. <br />Howard stated that should the citizens vote to purchase this land in November, the <br />valuation would not change and are fixed based on the Annexation Agreement. <br /> <br />Brown stated that during this process there have been a number of community meetings, <br />and that what has been presented represents compromises made by everyone. Brown <br />commented that he admired the persistence of CAPPOS, but disagreed with Mr. Hine's <br />position.
