ORDINANCE NO. 1175 <br />SERIES 1994 <br />AN ORDINANCE AUTHORIZING THE LEASE OF A PORTION OF PINE <br />STREET ADJOINING THE EAST 87.5 FEET OF THE SOUTH HALF OF <br />LOT 21, BLOCK 5, TOWN OF LOUISVILLE, TO SHERI S. LEVINE. <br />WHEREAS, Sheri S. Levine is the buyer under a contract to <br />purchase the East 87.5 feet of the South Half of Lot 21, and the <br />East 87.5 feet of Lot 22, Block 5, TOWN OF LOUISVILLE, County of <br />Boulder, State of Colorado, also known as 641 Main Street, <br />Louisville, Colorado; and <br />WHEREAS, certain elements of the existing building and <br />proposed improvements thereto having an address of 641 Main Street, <br />Louisville, Colorado, as more particularly depicted and described <br />in the Final Planned Unit Development Plan for 641 Main Street, <br />City of Louisville, County of Boulder, State of Colorado, encroach <br />upon Pine Street; and <br />WHEREAS, the City Council desires to grant a lease for the <br />encroachment so that such property can be used in accordance with <br />a Final Planned Unit Development Plan for 641 Main Street and is <br />marketable. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Mayor and the City Clerk are hereby <br />authorized to execute a ten (10) year lease to Sheri S. Levine for <br />that portion Pine Street upon which certain elements of 641 Main <br />Street, as depicted and described on the approved Final Planned <br />Unit Development Plan for 641 Main Street, primarily located on the <br />East 87.5 feet of the South Half of Lot 21, and the East 87.5 feet <br />of Lot 22, Block 5, TOWN OF LOUISVILLE, encroach, described as <br />follows: <br />The East 87.5 feet of the south 4.5 feet of the North <br />Half of Lot 21, Block 5, TOWN OF LOUISVILLE, County of <br />Boulder, State of Colorado, as shown on the Improvement <br />Location Certificate which accompanies this ordinance. <br />Section 2. The authority granted to the Mayor and the City <br />Clerk in Section 1 of this ordinance may be exercised only after <br />the City Council has approved the Final Planned Unit Development <br />Plan for 641 Main Street submitted by Sheri S. Levine and after <br />Sheri S. Levine closes on, and acquires fee title to, the East 87.5 <br />feet of the South Half of Lot 21, and the East 87.5 feet of Lot 22, <br />Block 5, TOWN OF LOUISVILLE. <br />1 <br />
