Louisville City Council Meeting <br />November 6, 2001 <br />Page 8 <br /> <br />ordinance, the City Comprehensive Plan, the City Commercial Development Design <br />Standard and Guidelines, the existing approval for the Village Square Shopping Square <br />Center that are related to the Safeway site, the proposed SRU, and any other public <br />records in the Planning Department files that are related to this application. <br /> <br />MOTION: Davidson moved that the materials identified by the City Attorney be <br />included in the record, seconded by Brown. All in favor. Mayer and Howard excused. <br /> <br />Planning Director Paul Wood reviewed that the applicant is Safeway Stores, represented <br />by Galloway, Romero & Associates. He stated that David Moore of Galloway, Romero <br />& Associates will make the applicant presentation. <br /> <br />Wood stated that the applicant is requesting a PUD amendment and a Special Review <br />Use. The underlying PUD for Village Square Shopping Center, Safeway, 707 South <br />Boulder Road, was approved in 1978 and the Safeway store opened the following year. <br />Wood noted that this is the second of two amendments. In 1999, Safeway requested a <br />review and received approval for minor additions to the front of the store and landscaping <br />of the parking lot. He noted that the 1999 landscaping addition doubled the landscape <br />coverage from 7% to 15%. Council approved the elimination of 48 parking spaces out of <br />the proposal. <br /> <br />Wood stated that the applicant is requesting authorization that would allow for the <br />construction of a Fueling Facility (Gas Station) at the Safeway store site. The area of the <br />proposed station is 15,000 SF, the size of the kiosk-storefront is 352 SF; the area of the <br />canopy over the pump island is 6,050 SF, the number of pump islands proposed is six or <br />24 pumps. The amendment is subject to the CDDSG. <br /> <br />Wood reviewed that the Planning Commission, at their October 9, 2001 meeting, voted to <br />recommend denial by a vote of 3-2. He stated that two of the Commissioners were <br />sympathetic to Safeway's desire to increase their market share of sales. The remainder of <br />the Planning Commission recommended denial based upon the failure of the applicant to <br />demonstrate compliance with the CDDSG and SRU criteria. <br /> <br />Wood stated that neighborhood testimony on record reflects opposition to the proposal. <br />He requested that Council include in the record, a letter received from Cathleen Kessler, <br />1913 Centennial Drive, Louisville, citing increased noise, potential light and <br />environmental pollution. The record reflects neighborhood concerns over increased noise, <br />traffic, pedestrian use of the parking lot, shoppers, potential light pollution and other <br />environment pollution such as fumes and gas spillage. Wood stated that the applicant has <br />addressed environmental safeguards with regards to the construction of tanks and <br />pumping apparatus. <br /> <br />Wood reviewed the Site Plan that provides the location of the fueling center, which <br />requires all the traffic to circulate through the existing parking lot.
