<br />ORDINANCE NO. 1163 <br />SERIES 1994 <br /> <br />AN ORDINANCE RELATING TO THE PAYMENT OF CITY MONEYS <br />PURSUANT TO A PURCHASE CONTRACT TO BUY AND SELL VACANT <br />REAL ESTATE AND CONSERVATION EASEMENT BETWEEN THE CITY OF <br />LOUISVILLE AND KLUBERT AND HELEN ROSE WAREMBOURG. <br /> <br />WHEREAS, the City of Louisville and Klubert and Helen Rose <br />Warembourg have entered into a Purchase Contract to Buy and Sell <br />Vacant Real Estate and Conservation Easement dated July 21, 1994 <br />("Contract"); and <br /> <br />WHEREAS, the Contract provides in part that the City shall pay <br />the Warembourgs a total of two million dollars ($2,000,000) for <br />certain property and rights as described in the Contract; and <br /> <br />WHEREAS, the City Council wishes to identify the sources of <br />funding for the two million dollars payment. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br /> <br />Section 1. Unless other funds become available for use by <br />the City as determined by the City Council, moneys from the <br />following funds may be used to pay during 1994 the two million <br />dollars under the Contract, subject to any necessary budgetary <br />transfers or supplementary budgets and appropriations in accordance <br />with State law: <br /> <br />Conservation Trust Fund $ 400,000 <br />General Fund 1,100,000 <br />Golf Course Fund 256,000 <br />Capital Projects Fund 132,000 <br />hltemal Service Fund 112,000 <br />TOTAL $2,000,000 <br /> <br />Section 2. If the funds described in Section 1 are used to <br />pay the two million dollars under the Contract, it is the intention <br />of the City Council that the funds described in Section 1 (other <br />than the Conservation Trust Fund) be reimbursed from the <br />Conservation Trust Fund over a period of time no longer than four <br /> <br />1 <br />
