Case Manager: Sean McCartney, Principal Planner <br /> <br />Conflict ofInterest and Disclosure: <br />Deborski stated he lives in the neighborhood, two (2) blocks away, but does not view that as a <br />conflict of interest. <br /> <br />Public Notice Verification: <br />Published in the Daily Camera on August 26, 2007. Posted in City Hall, Public Library, <br />Recreation Center and the Police and Courts Building and mailed to surrounding property <br />owners on August 24,2007. <br /> <br />Staff Report of Facts and Issues: <br />McCartney provided the following summary: <br />. A minor subdivision replat for a two-lot single-family residential subdivision (Lot 1 <br />through 4, Block 10, Pleasant Hill Addition). <br />. Currently there are two houses on the four (4) lots addressed as 637 Lincoln (Lots 1 <br />and 2) and 635 Lincoln (Lots 3 and 4). <br />. Pleasant Hill was originally platted on July 11, 1894. <br />. In August, 2003 the applicant created a Covenant Agreement to consolidate the four <br />(4) lots into one-single ownership so they could connect the two houses into one <br />adjoining living space. <br />. The applicant is now requesting to separate the lots into two (2) lots, as they had <br />originally been. <br />. According to the Improvement Location Survey, provided by the applicant at time of <br />application, 637 Lincoln is located approximately 12 inches from the property line at <br />635 Lincoln, also 635 is approximately 3.4 feet from the shared property line. <br />. The structure at 637 Lincoln was built in 1900 while the structure at 635 Lincoln was <br />built in 1910. <br />. Any future demolition is subject to review under the regulations of the City's Historic <br />Preservation Ordinance. <br />. Public Works has requested a 4.4' maintenance easement be placed on the south line <br />of Lots 1 and the north line of Lots 2 for the maintenance of the existing structure. <br />The maintenance easement will be utilized by the homeowners when they are doing <br />maintenance on the structures. <br />. Public Works also recommends the applicant confirm sanitary sewer service lines for <br />each house using an electronic locating device and provide a copy of a Revocable <br />License Agreement for the existing fence located along Pine Street. The existing <br />fence encroaches into the right-of-way. <br /> <br />Staff recommends approval of Resolution No. 22, Series 2007 with three conditions: <br />1) The applicant shall dedicate on the subdivision plat a 4.4 foot maintenance agreement <br />between the structures on Lots 1 and 2 for the purpose of maintenance. This easement <br />shall be delineated on the plat prior to recordation. <br />
