RESOLUTION N0.53 <br />SERIES 2007 <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT FOR TWO LOTS AT <br />637 AND 625 LINCOLN AVEL~TUE, LOTS 1 THROUGH 4, BLOCK 10, PLEASANT <br />HILL ADDITION, KNOWN AS SCHMIDT MINOR SUBDIVISION <br />WHEREAS, there has been submitted to the Louisville City Council, a request of a final <br />subdivision plat for a two lot residential subdivision known as the Schmidt Minor Subdivision; <br />and <br />WHEREAS, all materials rf;lated to the final subdivision plat have been reviewed by <br />City Staff and the Planning Commission and found, to be in compliance with the Louisville <br />zoning ordinances, subdivision regulations, and related policies and previous approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said final subdivision plat on <br />September 13, 2007, where evidence and testimony were entered into the public record, <br />including the Staff Report dated September 13, 2007, the Planning Commission recommended <br />approval to the City Council, with tl~e following conditions; <br />1. The applicant shall dedicate on 1:he subdivision plat a 4.4 foot maintenance easement between <br />the structures on Lots 1 and 2 for the purpose of maintenance on the structures. This <br />easement shall be delineated on the plat prior to recordation. <br />2. The applicant shall confirm sanitary sewer service lines for each house using an electronic <br />locating device. <br />3. Owner shall provide a copy of a Revocable License Agreement for the existing fence located <br />along Pine Street. The existing fence encroaches into the right-of--way; and <br />The applicant was able to comply with all of the conditions prior to submittal for City Council. <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission that thf; condition was met and finds that the application should be <br />approved, without conditions. <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, <br />Colorado does hereby approve a final subdivision plat for Schmidt Minor Subdivision. <br />~ ~~ S.J ~ ...,,~ <br />~~~~ED DOPTED this 2°a day of October, 20 <br />~. ~,,•:~ <br />~~ ~ <br />~' BY: <br />~v ~~.° ~~~' ~ ~ Charles L.
