RESOLUTION NO. 48 SERIES 1993 A RESOLUTION CONCERNING REGULATION OF BASIC SERVICE RATES OF ANY CABLE TELEVISION FRANCHISEE PROVIDING BASIC SERVICE WITHIN THE CITY OF LOUISVILLE, COLORADO. WHEREAS, the Cable Television Consumer Protection and Competition Act of 1992 (the "1992 Cable Act") and the regulations promulgated pursuant thereto authorize local governments empowered under state law to regulate cable television rates to apply for authorization to regulate basic service rates; and WHEREAS, the City Council of Louisville has found that the City has authority under state law to regulate cable television rates within the City; and WHEREAS, the City Council authorized the filing with the Federal Communications Commission ("FCC") of an application for Certification to Regulate Basic Cable Service and such application was filed with the intent to comply with all FCC regulations applicable to regulation of basic cable service rates. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The City Council hereby expressly declares its intent that basic cable service rates shall be regulated within the City of Louisville, Colorado, following and in full compliance with all applicable FCC regulations, and the 1992 Cable Act, as amended from time to time. 2. All procedures followed by the City in regulating basic cable service rates shall provide reasonable opportunity for participation by the public. 3. The City Council shall consider additional procedures and regulations for basic cable service rates from time to time, but any such regulations shall at all times be consistent with applicable FCC regulations. 4. This Resolution shall apply to the regulation of basic service rates of any cable television franchise providing basic service within the City of Louisville, Colorado. 1
