She supported allowing up to six hens. Eric Sundberg, 785 Trail Ridge Drive, Louisville, CO explained his home has a 4 -foot fence, which is the only fence allowed by the HOA. He did not believe hens could get through the slots in a fence and noted no matter how high the fence, the coop will always be visible, but felt coops could be made to be attractive. COUNCIL DIRECTION: There was Council support for staff to bring forward an ordinance allowing backyard hens. RESOLUTION No. 41, SERIES 2013 — A RESOLUTION APPROVING A REFUND FOR WATER AND SEWER TAP FEES FOR CONFLUENCE DEVELOPMENT Mayor Muckle requested a staff presentation. City Manager Fleming explained the City Council adopted Ordinance No. 1633, Series 2013 implementing revisions recommended by staff to the water and sewer tap fees for multifamily units. These revisions provided for the multifamily equivalency unit to be reduced from 60% to 45% for a water tap fee if a development provided a separate irrigation tap. Additionally, Council approved revising the sewer tap fee from 60% to 80% to reflect actual equivalency rates observed from utility billing data analysis performed by staff. The ordinance provides for taps, which were purchased and paid for but not installed as of the date of the ordinance's approval to receive a refund. Confluence Development (Steel Ranch South Apartments) has requested consideration of a refund of water and sewer tap fees they paid prior to Council's approving Ordinance No. 1633. Staff supported the request made by Confluence Development and recommended the City Council approve the proposed resolution. APPLICANT PRESENTATION Anthony DiSimone, Confluence Development (Steel Ranch South Apartments), requested a refund of water and sewer tap fees they paid prior to Ordinance No. 1633, Series 2013 in the amount of $643,163. COUNCIL COMMENT Council member Keany inquired whether funds will be refunded or credited to other projects. It was discussed that the amount could be credited to other projects. City Attorney Light noted there will be additional documentation, which will accompany the irrigation tap and be signed by the developer and the City. Council member Keany stated his understanding in the initial tap calculations, the irrigation tap was from the buildings. Now a separate irrigation tap is to be established.
