Chickens lay five eggs <br />per week, which is not sufficient for a family. She supported allowing up to six hens. <br />Eric Sundberg, 785 Trail Ridge Drive, Louisville, CO explained his home has a 4 -foot <br />fence, which is the only fence allowed by the HOA. He did not believe hens could get <br />through the slots in a fence and noted no matter how high the fence, the coop will <br />always be visible, but felt coops could be made to be attractive. <br />COUNCIL DIRECTION: There was Council support for staff to bring forward an <br />ordinance allowing backyard hens. <br />RESOLUTION No. 41, SERIES 2013 — A RESOLUTION APPROVING A REFUND <br />FOR WATER AND SEWER TAP FEES FOR CONFLUENCE DEVELOPMENT <br />Mayor Muckle requested a staff presentation. <br />City Manager Fleming explained the City Council adopted Ordinance No. 1633, Series <br />2013 implementing revisions recommended by staff to the water and sewer tap fees for <br />multifamily units. These revisions provided for the multifamily equivalency unit to be <br />reduced from 60% to 45% for a water tap fee if a development provided a separate <br />irrigation tap. Additionally, Council approved revising the sewer tap fee from 60% to <br />80% to reflect actual equivalency rates observed from utility billing data analysis <br />performed by staff. The ordinance provides for taps, which were purchased and paid <br />for but not installed as of the date of the ordinance's approval to receive a refund. <br />Confluence Development (Steel Ranch South Apartments) has requested consideration <br />of a refund of water and sewer tap fees they paid prior to Council's approving Ordinance <br />No. 1633. Staff supported the request made by Confluence Development and <br />recommended the City Council approve the proposed resolution. <br />APPLICANT PRESENTATION <br />Anthony DiSimone, Confluence Development (Steel Ranch South Apartments), <br />requested a refund of water and sewer tap fees they paid prior to Ordinance No. 1633, <br />Series 2013 in the amount of $643,163. <br />COUNCIL COMMENT <br />Council member Keany inquired whether funds will be refunded or credited to other <br />projects. It was discussed that the amount could be credited to other projects. City <br />Attorney Light noted there will be additional documentation, which will accompany the <br />irrigation tap and be signed by the developer and the City. <br />Council member Keany stated his understanding in the initial tap calculations, the <br />irrigation tap was from the buildings. Now a separate irrigation tap is to be established. <br />
