2. That the location cannot feasibly be serviced during permitted hours, and that the variance is the least necessary to permit trash removal while still assuring nearby residents reasonable nocturnal quiet. Sec. 9.34.070. Enforcement. A. Violations: It is unlawful for any person to violate any provision of sections 9.34.010 through 9.34.070 of this chapter. Each violation, and each day of a continuing violation, shall constitute a separate violation, the mandatory minimum penalty for which shall be the imposition of a fine in the amount of $20.00. B. Court-Ordered Abatement: Violations of any provisions of sections 9.34.010 through 9.34.070 of this chapter are deemed and declared to be a nuisance and as such may be subject to summary abatement by means of a restraining order or injunction issued by the municipal court or other court of competent jurisdiction. The municipal court is authorized to issue injunctive relief in cases of such violations. Section 4. If any portion of this ordinance is held to be invalid for any reason, such decisions shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declarf;s that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid. Section 5. The repeal or modification of any provision of the Municipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions. Section 6. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
