That the location cannot feasibly be serviced during permitted hours, and that <br />the variance is the least necessary to permit trash removal while still assuring <br />nearby residents reasonable nocturnal quiet. <br />Sec. 9.34.070. Enforcement. <br />A. Violations: It is unlawful for any person to violate any provision of sections <br />9.34.010 through 9.34.070 of this chapter. Each violation, and each day of a continuing <br />violation, shall constitute a separate violation, the mandatory minimum penalty for which <br />shall be the imposition of a fine in the amount of $20.00. <br />B. Court-Ordered Abatement: Violations of any provisions of sections 9.34.010 <br />through 9.34.070 of this chapter are deemed and declared to be a nuisance and as such <br />may be subject to summary abatement by means of a restraining order or injunction <br />issued by the municipal court or other court of competent jurisdiction. The municipal <br />court is authorized to issue injunctive relief in cases of such violations. <br />Section 4. If any portion of this ordinance is held to be invalid for any reason, <br />such decisions shall not affect the validity of the remaining portions of this ordinance. <br />The City Council hereby declarf;s that it would have passed this ordinance and each part <br />hereof irrespective of the fact that any one part be declared invalid. <br />Section 5. The repeal or modification of any provision of the Municipal Code <br />of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or <br />change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which <br />shall have been incurred under such provision, and each provision shall be treated and held <br />as still remaining in force for the purpose of sustaining any and all proper actions, suits, <br />proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as <br />well as for the purpose of sustaining any judgment, decree, or order which can or may be <br />rendered, entered, or made in such actions, suits, proceedings, or prosecutions. <br />Section 6. All other ordinances or portions thereof inconsistent or conflicting <br />with this ordinance or any portion hereof are hereby repealed to the extent of such <br />inconsistency or conflict. <br />INTRODUCED, READ, ]PASSED ON FIRST READING, AND ORDERED <br />PUBLISHED this day of , 2007. <br />6 <br />
