<br /> <br /> <br /> <br />BRAD COMMUNICATION <br />SUBJECT: 2014 DOWNTOWN PATIO PROGR AM DISCUSSION <br /> <br />DATE: SEPTEMBER 9, 2013 PAGE 4 OF 4 <br /> <br /> <br />During the 2013 season, the City made the new, City-owned patios available for free to <br />all participating food establishments. To make that benefit available for other food <br />establishments that have not previously used the downtown patios, the first patio <br />season a business participates in the patio program will be free. <br /> <br />SPECIAL SITUATION FOR REX: <br />When the Rex rooftop patio was approved, a condition was placed requiring the <br />restaurant to “provide sidewalk dining in the appropriate seasons to maintain street level <br />pedestrian activities”. That requirement was made when the patios were not controlled <br />by the restaurant or the City. Should the patio program charge a fee, the Rex would run <br />counter to its PUD requirement should the business choose not to participate in the <br />patio program. <br /> <br />Additional details will be needed, including exact patio locations, insurance <br />requirements, coordination with alcohol premises licensing, and others. <br /> <br />RECOMMENDATION: <br />Staff has not formulated a recommendation at this time. Staff would like to receive input <br />from the BRaD committee, a public meeting, and a City Council study session prior to <br />making a recommendation. <br /> <br />ATTACHMENTS: <br />1.
