RESOLUTION NO. 53 <br />SERIES 2013 <br />A RESOLUTION APPROVING AN AMENDMENT TO A FINAL SUBDIVISION PLAT <br />AND FINAL PLANNED UNIT DEVELOPMENT TO ALLOW FOR STEEL RANCH <br />MARKETPLACE — A COMMERCIAL /RETAIL DEVELOPMENT <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of an amendment to a final subdivision plat and final planned <br />unit development to allow for Steel Ranch Marketplace — a commercial /retail <br />development; and, <br />WHEREAS, all materials related to the final subdivision plat and final planned <br />unit development (PUD) plan have been reviewed by City Staff and the Planning <br />Commission and found, subject to conditions, to be in compliance with the Louisville <br />zoning ordinances, subdivision regulations, related policies and previous approvals; and <br />WHEREAS, after duly noticed public hearing where evidence and testimony was <br />entered into the record, including without limitation the findings in the Louisville Planning <br />Commission Staff Reports dated September 26, 2013, the City of Louisville Planning <br />Commission approved a resolution to forward a recommendation of approval, with <br />conditions to the City Council; and, <br />WHEREAS, City Council has reviewed the application, the Staff Report October <br />15, 2013, along with the recommendation of the Planning Commission and finds that <br />said final subdivision plat and final planned unit development (PUD) plan should be <br />approved, subject to the following conditions: <br />1. The applicant shall provide the City of Louisville with an updated traffic count to be <br />used by CDOT for additional review to warrant the traffic signal at Highway 42 and <br />Paschal Drive. <br />2. The temporary access points shall be constructed of asphalt and graded to drain <br />to the regional drainage system. <br />3. The undeveloped Lots 2 and 3 shall be seeded with native seeding. <br />4. The proposed wall signs on the eastern facade of the Building shall not exceed <br />combined area of 231- square feet. <br />5. The proposed wall signs on the eastern facade of the Building shall be specific to <br />the art center use, may not be transferred to another use and shall be externally lit <br />by down casting lighting. Any other use shall be subject to the signage maximum <br />square footage requirements then in effect and shall submit a PUD amendment <br />for the replacement signage. <br />6. Signs shall only be allowed on three sides of the proposed building. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado, based on the evidence and testimony presented at the hearings, <br />does hereby approve the final subdivision plat and final planned unit development <br />(PUD) plan for the Steel Ranch Marketplace development in northern Louisville, subject <br />to the conditions set forth above. <br />Resolution No. 53, Series 2013 <br />Page 1 of 2 <br />
