Louisville City Council Meeting
October 15, 2002
Page 4

Mayer noted that this is the second time that the City has won the national EPA award.
He stated that the City was the recipient of this award in 1992. He congratulated the
Public Works Department and its Director Tom Phare.

BOARD & COMMISSION APPOINTMENT

Davidson explained that on October 1 and 15, 2002, Council interviewed applicants to
fill vacancies on City Boards and Commissions. The Louisville Historical Commission
has two vacancies to complete four-year terms expiring January 2004.

MOTION: Sisk moved that Council appoint Donna Hauswald and Diane Marino to the
fill the two-year terms, seconded by Brown. All in favor.

Davidson recused himself from the discussion and vote of the appointments to the Board
of Adjustments. He explained that he is related to one of the applicants.

MOTION: Sisk moved that Council appoint Bill Cordell to the Board of Adjustments,
for the term expiring in January of 2003, and Sharon Davidson to the term expiring in
January of 2005, seconded by Keany. All in favor. Davidson excused. Mayer abstained.

Davidson returned to the meeting.

ORDINANCE NO. 1401, SERIES 2002 - AN ORDINANCE ESTABLISHING A
HISTORIC PRESERVATION COMMISSION AS REQUIRED BY THE HOME
RULE CHARTER, TO SERVE AS AN ADVISORY COMMISSION TO THE
CITY COUNCIL - 2aa reading - public hearing (advertised Daily Camera 10/5/02)

Davidson called for City Attorney introduction.

City Attorney Sam Light read Ordinance No. 1401, Series 2002.

Davidson called for Staff presentation.

Deputy City Manager Julie Boyd explained that the Home Rule Charter requires that a
Historic Preservation Commission be established by the City Council, which shall not be
abolished. Ordinance No. 1401, Series 2002 establishes the Commission. Resolution No.
34, Series 2002 sets forth the details of the Commission's purpose, membership,
responsibilities and powers. If at a later date, Council wishes to expand or amend those
specific responsibilities, those changes can be made with a new resolution rather than
repealing and re-enacting the ordinance, thereby assuring compliance with the Charter.

Davidson opened the public hearing and asked if anyone in the audience wished to speak
for or against Ordinance No. 1401, Series 2002. Hearing none, Davidson closed the
public hearing.

4
