RESOLUTION NO. 66 <br />SERIES 2013 <br />A RESOLUTION APPROVING A CONSERVATION EASEMENT FROM THE CITY <br />AND COUNTY OF BROOMFIELD OVER THE LUSTIG PROPERTY PURSUANT TO <br />THE SOUTHEAST BOULDER COUNTY, SOUTH 96TH STREET, DILLON ROAD <br />AND US 287 AREA COMPREHENSIVE DEVELOPMENT PLAN IGA <br />WHEREAS, the City of Louisville, City of Lafayette, City and County of Broomfield and <br />County of Boulder are parties to the Southeast Boulder County, South 96th Street, Dillon Road <br />and US 287 Area Comprehensive Development Plan Intergovernmental Agreement, dated <br />February 18, 1999, and recorded in the Boulder County Clerk and Recorder's Office on March <br />15, 1999, at Reception Number 1916399, as amended ( "Northwest Parkway IGA "); and <br />WHEREAS, the parties entered into the Northwest Parkway IGA in order to plan for <br />future development and annexations within the southeast portion of Boulder County and for the <br />construction of the Northwest Parkway; and <br />WHEREAS, the Northwest Parkway IGA was amended by the parties on February 6, <br />2001, which amendment was recorded in the Boulder County Clerk and Recorder's Office on <br />August 24, 2001, at Reception Number 2189244 ( "Amendment "); and <br />WHEREAS, paragraph 6.3 of the text portion of Exhibit A of the Northwest Parkway <br />IGA and paragraph 4.3 of the Amendment require that the parties convey to each other reciprocal <br />conservation easements over and across all open space properties within an area defined in the <br />Northwest Parkway IGA; and <br />WHEREAS, the City and County of Broomfield has acquired certain real property <br />referred to as the Lustig Property and more particularly described in Exhibit A to the Deed of <br />Conservation Easement in Gross accompanying this Resolution ( "Property "), which Property <br />consists of approximately 4.808 acres and is referenced in Paragraph 4.10 of Exhibit A of the <br />Northwest Parkway IGA; and <br />WHEREAS, in order to further implement the requirements of the Northwest Parkway <br />IGA, there has been prepared and presented to the City Council a grant of a conservation <br />easement in gross over the Property, which instrument is more specifically identified as the <br />Lustig Property Deed of Conservation Easement in Gross Located at 2613 Brainard Drive, <br />Broomfield, CO ( "Conservation Easement "); and <br />WHEREAS, the City Council finds that approval and execution of the Conservation <br />Easement is in furtherance of the purposes, intent and requirements of the Northwest Parkway <br />IGA and Amendment; and <br />WHEREAS, the City Council finds that approval and execution of the Conservation <br />Easement is in furtherance of the public benefit to be served by the preservation of the Property <br />subject to said Conservation Easement; and <br />Resolution No. 66, Series 2013 <br />Page 1 of 2 <br />
