Board of Adjustment <br />Meeting Minutes <br />February 19, 2014 <br />Page 3 of 6 <br />• There are other properties along Via Appia which have 4 foot fences, but there <br />are also other properties that have 6 foot fences. <br />▪ The topographical relationship between Via Appia (higher) and the properties <br />(lower) create a hardship for privacy and noise. <br />• Staff finds all 6 variance criteria, which are applicable, are in compliance. <br />• Staff recommends approval of this request. <br />Questions from Board to Staff: <br />No questions <br />Applicant Presentation and questions from the Board to the applicant: <br />Kevin Sullivan, applicant, stated he agreed with staffs assessment and asked if the <br />board had any questions. <br />Malmquist asked to clarify if all homeowners are in agreement with the request. <br />Sullivan answered in affirmative. <br />Malmquist asked if all of the fences would look similar. <br />McCartney stated he believed they would all look similar. <br />Sullivan stated all of the applicants would be pulling their own building permit. <br />Malmquist stated that could result in all fences might loo differently. <br />Public Present in Opposition of Application <br />None heard. <br />Public Present in Favor of Application: <br />None heard. <br />Public Hearing Closed / Board Discussion: <br />Stuart stated he agreed with staff, all criteria had been met, and the fence should be 6 <br />feet tall. v <br />Meseck stated he believes the fences should be 6 feet as well. <br />Borrmann stated he agreed with the other commission members. <br />Malmquist made a motion to approve.
