City Council <br />Meeting Minutes <br />April 1, 2014 <br />Page 14 of 24 <br />John Leary, 1116 LaFarge Avenue, Louisville, CO voiced his concern and confusion <br />over the quasi - judicial process and the public's access to information. <br />City Attorney Light explained the Comprehensive Plan is a legislative process and not a <br />quasi - judicial process. The site plan for a specific property is a quasi - judicial process <br />where regulatory rules are being applied. In some Case Laws, changes to the <br />regulatory rules follow the quasi - judicial process to enable notice to the interested <br />parties. Changes to the zoning ordinance should be noticed for all the interested parties. <br />John Leary, 1116 LaFarge Avenue, Louisville, CO was surprised this version led to the <br />presumption of rezoning. He was not aware the Council's priority was in rezoning. He <br />stated the highest priority of the Comprehensive Plan was the public request for small <br />town character. The small area plan should maintain small town character as defined <br />by the people and by maintaining financial sustainable city. He did not see either of <br />those issues as a driving force in the process for the small area plan. He was also <br />concerned the steering committee would be selecting the options. He did not feel the <br />problems in the Comprehensive Plan could be fixed through the small area plan. <br />He voiced his confusion over the process especially the presumption of rezoning. <br />Debbie Fahey, 1118 W. Enclave Circle, Louisville, CO stated stakeholders cannot be <br />limited to 500 feet of the property. She felt every Louisville resident is a stakeholder in <br />what happens in the City. She thought it would be helpful if the discovery and desires <br />categories were switched. It would make the public input more effective. <br />COUNCIL COMMENTS <br />Council member Stolzmann stressed the importance of Council deciding what they want <br />to see in the small area plan. She asked Council if they just want to fill in the candy <br />cane striped areas in the Comprehensive Plan or do they want something else. <br />Mayor Muckle wanted to see a document the citizens would like. Once the small area <br />plan is completed, the Council can decide whether it should be codified and the small <br />area plan would finish the Comprehensive Plan. His primary objective was to get <br />people comfortable with the process. He thanked Planning Director Russ for making <br />the requested changes and noted it is significantly different from what was presented <br />earlier. He was interested in getting the citizen's perspective on the small town and <br />agreed the fiscal model should be used early in the process. <br />Council member Keany stated his understanding the process will address the candy <br />cane striped areas along South Boulder Road and it is a small area plan and not a <br />neighborhood plan. <br />Planning Director Russ explained it is the candy cane striped area, which will give <br />definition at a Comprehensive Plan level, but if the yard and bulk standards need to <br />change to establish character, the commercial guidelines need to be updated.
