WHEREAS, said public hearing was held on May 4, 1976 and which hearing was continued to and closed on June 1, 1976, and WHEREAS, the Louisville, Colorado master plan and utility plans do not project the need for nor the construction of any new domestic water or sewage treatment systems, and WHEREAS, the City staff and consultants have recommended to the City Council that the City incorporate the requirements and evaluation criteria contained in the Land Use Commission "Mode Regulations", Chapter 15, Major Extensions of Existing Domestic Water and Sewage Treatment Systems into existing City land use and development control ordinances, resolution:> and regulations to achieve a more timely and continuing review and evaluation than permitted under H.B. 1041 (9174) to avoid unnece<.~sary and counter-productive duplication of controls, and WHEREAS, § 2-1-104 of the Colorado Land Use Commission "Guidelines for :identification ancf Designation", adopted September 19, 1975 provide for achieving the intent of H.B. 1041 (1974) through land use control procedures authorized t-y statute other than H.B. 1041 (1974), and WHEREAS, the City staff and consultants have met and worked with the Land Use Commission staff to assure that the intent of H.B. 1041 (1974) would be achieved through proper amendment of existing land use and development control ordinances, resolutions and regulations, and WHEREAS, the Land Use Commission staff has testified that, in the staff's judgment and opinion, the intent of H.B. 1041 can be achieved through amendment of existing City land use and development control ordinances, resolutions and regulations if the City of Louisville adopts the proposed amendments submitted to the Lead Use Commission staff on May 28, 1976 and if the City adopts other such resolutions and agreements recommended by the Land Use Commission staff. -2-
