develop, operate and contro:L all necessary water and sewage drains, <br />pipelines, flumes, settling ponds, treatment plants or compensating reser- <br />voirs, and <br />WHEREAS, the aforementioned corporation, its powers, projects, <br />and purposes are to be exercised in order to aid the member municipalities <br />in the conduct of water and sewage services but not to supplant the muni- <br />cipal services within municipal boundaries, and <br />WHEREAS, it is to the mutual benefit of the Coal Creek municipalities <br />to form such corporation, <br />NOW, THEREFORE, be it resolved, by the City Council of Louisville, <br />that the Coal Creek Water Users Association, Incorporated, as formed under <br />C.R.S. 1963 31-19-1 et. seq_. has the full support and backing of the City <br />of Louisville. <br />AND, FURTHER, the City hereby pledges its financial support of <br />!~0% of the Coal Creek ProjE~ct, and by this resolution hereby accepts l+0% <br />of the project indebtedness to date of signing of this resolution, said <br />share not to exceed $200.00. Any further expenses exceeding $200.00 shall, <br />to insure continuing support, have to be approved by this City Council, <br />before the City becomes obligated for its 1~0% share of any such expenses <br />or indebtedness. The City understands that failure to assume its percen- <br />tage share of project obligations wY~re required by this paragraph shall <br />result in termination of corporate membership of this municipality, as <br />shall be evidenced by a revocation of the certificate of membership of the <br />municipality. In the event such termination occurs, the City agrees to re- <br />main bound to the corporation on its obligations for past expenses. <br />When a provision of this resolution is found to be in conflict with <br />a provision of any ordinance, code or charter of this initiating munici- <br />pality, or other member municipality pertaining to the subject of water <br />or sewage programs, projects or services, that provisions which provides <br />the higher standard for the promotion and protection of the health and <br />safety of the people and which promotes the utilitarian plans of this cor- <br />poration shall prevail. <br />-2- <br />
