At 114.5' deep, this is not possible. <br />2. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located; <br />(A) The proposed lot widths of 65' and 60' are more consistent with the property widths <br />throughout the neighborhood. The existing property width of 125' is very unusual to <br />the neighborhood. <br />(B) The shallow lot depth of 114.5' is unique only to the west side of Lincoln Ave, while <br />the remaining neighborhood has 125' deep lots. The proposed lot areas are consistent <br />with the neighborhood. Most properties in this neighborhood consist of two standard <br />lots (25'x125'). The typical lot area is therefore 6,250 sf. Both lots exceed this area, <br />while at same time, are not capable of reaching the minimum requirements. However, <br />they are reasonably close in size to the required minimums. <br />3. That because of such physical circumstances or conditions, the property cannot <br />reasonably be developed in conformity with the provisions of this title (Louisville <br />zoning code); <br />(A) The existing property is 125' wide therefore two reasonably sized properties in the <br />proposed subdivision cannot meet the 70' min. lot width requirement. <br />(B) The existing property due to it's unusual depth is not able to accommodate the mini- <br />mum area requirements, as outlined in #1. <br />4. That such unnecessary hardship has not been created by the applicant; <br />The 5-lot property was purchased in its entirety over 35 years ago by the current owner <br />prior to the adoption of the current Municipal Code and Old Town Overlay Regulations. <br />The owner has done nothing to create the hardship. <br />5. That the variance, if granted, will not alter the essential character of the <br />neighborhood or district in which the property is located, nor substantially or <br />permanently impair the appropriate use or development of adjacent property; <br />This variance will enhance the character of the neighborhood by creating two lots that are <br />more consistent with the surrounding neighborhood. The current property is much larger in <br />size than any of the surrounding lots in the area. The two new lot sizes will be more con- <br />sistent in size and width compared to the surrounding neighborhood properties. In addi- <br />tion, both lots will front Lincoln Ave.The variance will have little to no impact on the adja- <br />cent property other than enhancing the current conditions. <br />6. That the variance, if granted, is a minimum variance that will afford relief and is the <br />least modification possible of the provisions of this title (Louisville zoning code) which <br />are in question. <br />The proposed subdivision of the lots is reasonable, and has a minimal impact on the <br />neighborhood in the terms lot size, potential future house size, and scale. <br />
