He added the public did believe food <br />trucks could be used for CTC, unique community events, and Street Faire. <br />This ordinance: <br />Definitions –Mobile Food Vehicle, Mobile Retail Food Establishment and <br />o <br />Mobile Vending Cart <br />Creates a new use group –allowed as a use by right in A-O, B-O, A-OT <br />o <br />CC, CB, I, and MU-R/CC (private property only) <br />Sales Tax License required, Boulder County Public Health Certificate <br />o <br />required and Location requirements from existing restaurants. Russ <br />showed maps depicting 150’, 300’, 500’ and 700’ radii (buffers from <br />restaurants). <br />Performance criteria –Operating requirements such as time, placement <br />o <br />and safety were discussed <br />Staff recommends approval of the draft ordinance, as presented. <br />Commission Questions of Staff: <br />Rice asked if the City has any experience with food trucks in public rights of way. <br />Russ stated it currently is not permitted, only during special events. <br />Tengler asked how the Arts Center was able to get food trucks. <br />Russ stated it is permitted as a catered event as long as it was a pre-sold event. <br />Rice asked if it was on private property it is a use by right. <br />Russ stated yes it would require a business license and would have to comply with the <br />performance criteria. <br />Rice inquired about the location criteria and asked Russ to comment on the buffer <br />distances created. <br />Russ gave a quick rundown of how the buffers were created. <br />Rice asked if the other municipalities have had any issues with their ordinance. <br />Russ stated they haven’t stated any issues. <br />O’Connell asked if there could be a definition for an ice cream vendor. <br />Russ agreed. <br />
