Howard felt a 1" tap was fine and felt the annexation was far too important to quibble over something
like that.

Mayer felt the size of the tap should be worked out between the Mobleys and Public Works.

Howard moved that Council forward the Letter of Intent to Annex to the Planning Commission with
Council comments. Seconded by Keany. All in favor with Davidson being absent.

OWEN ANNEXATION

RESOLUTION NO. 55, SERIES 1996 - FINDING SUBSTANTIAL COMPLIANCE
FOR ANNEXATION PETITIONS FILED WITH THE CITY OF LOUISVILLE,
COLORADO, KNOWN AS THE OWEN ANNEXATION - 22.46 ACRES, AND
SETTING A PUBLIC HEARING THEREON - 10/15/96

Sisk excused himself from the Owen annexation due to a conflict of interest and appointed former
Mayor Pro- Tem Howard to preside over this portion of the meeting.

Paul Wood, Planning Director, stated that he would combine his comments on Resolution No. 55,
Ordinance No. 1231, and Ordinance No. 1232, Series 1996. He reported that the property is 22.46
acres, has sufficient contiguity with the City of Louisville, and that the applicant requested
Agricultural zoning. They planned on continuing their equestrian business on the property. The
applicant requested a waiver of the annexation fees, water rights, open space requirement, and capital
improvement fees. The property has the Owen's current residence and two existing manufactured
mobile structures which they requested be allowed to continue and the water line for that be allowed
to be split to service all three residences. The residences would be used for family members.

Howard called for the applicant's presentation.

Alan Owen, 1474 South 96th Street, Louisville, Colorado, was there to answer any questions.

Howard opened the public hearing calling for anyone wishing to speak on Resolution No. 55.

NONE

Howard closed the public hearing and called for Council comments or motions.

Lathrop mentioned that the Owens requested a I" tap to service three residences and an existing
equestrian operation while the Mobleys requested a 1" tap for each of two residences.

Mayer moved that Council approve Resolution No. 55, Series 1996, the Owen Annexation.
Seconded by Keany. All in favor with Sisk being excused and Davidson being absent.

4
